Dear Chairman Lee, members of the Barnstable Conservation Commission and Darcy Karle:
On behalf of the applicants and property owners, William and MaryBeth Eddy, Baxter Nye Engineering
& Surveying (BN) submits the enclosed Notice of Intent (NOI)(WPA Form 3) with site plans
(Attachment 1) and other supporting documentation proposing a single-family home project, partially
within the buffer zone to an Isolated Vegetated Wetland (IVW) at 0 Daffodil (aka 6 Daffodil) Lane in
Barnstable. BN files this NOI pursuant to the Massachusetts Wetlands Protection Act (M.G.L. Ch. 131,
§ 40) and its performance standards (310 CMR 10.00), the Town of Barnstable Wetlands Protection
Bylaw (Chapter 237), and in accordance with the town’s filings guidelines.
As illustrated on the project site plan (Site Plan by BN dated 09-20-2023), the project is proposed for an
area partially within the 50 and 100 foot buffer zones to an IVW resource area.
As the footprint of the proposed driveway is partially within the 50’ buffer zone to the IVW, the
applicant seeks a required waiver for projects proposed in the fifty-foot buffer zone under Chapter 704.
This waiver request is based solely on the necessary access by a narrow driveway required to access the
upland portion of the lot (please see the project narrative for further description).
BN submits this NOI pursuant to the Massachusetts Wetlands Protection Act, the Town of Barnstable
Wetlands Protection Bylaw, and local permit application submission guidelines. BN attests that it will
notify property abutters of this NOI filing and of the October 10, 2023 public hearing in accordance

1.0 Introduction / Summary
The project applicants, William and MaryBeth Eddy, own the property located at 0 Daffodil Lane
(aka 6 Daffodil Lane) in Barnstable (the Site) (see Figures 1 - 4). The applicant proposes to construct
a dwelling with a detached garage/carriage house, a pool with patio, a pool equipment shed, with
driveway access and appurtenant utilities on the 1.5 acre site. Baxter Nye Engineering &
Surveying (BN) has prepared a Site Plan, sheet C1.0 and Details plan, sheet C2.0 to accompany this
Notice of Intent and project narrative.
A portion of the pool patio, the driveway, and the pool equipment shed are proposed within the
buffer zone to an Isolated Vegetated Wetland (IVW). A portion of the driveway is within the 0-50’
buffer zone as this is the only access from Daffodil Lane to the upland portion of the lot. The house
and other proposed improvements are outside of the 100 ft buffer to IVW (outside of jurisdictional
area).
2.0 Existing Site Conditions
Geographical Setting and Wetland Resource Areas
The project site is located on the north side of Rt. 6A in Barnstable. The site lies at the end of a
private drive known as Daffodil Lane which is accessed off of Rt.6A. The accompanying site plan
represents the location of the jurisdictional wetland resource area (WRA), existing topography,
existing cleared areas and other features. The upland portion of the property is located
northeasterly of an Isolated Vegetated Wetland. The topography on the site varies from moderately
to severely sloping and the soil type consists of Plymouth loamy coarse sand. The only WRA on
the site is an isolated vegetative wetland (IVW). The Barnstable Wetlands Protection Bylaws
defines a Vegetated Wetland as an “Any area of at least 500 square feet where surface or ground
water, or ice, at or near the surface of the ground support a plant community dominated (at least
50%) by wetland species.” This IVW is as previously delineated and reviewed by this
Commission.
The IVW and the 50 and 100 foot buffer zones to this IVW are shown on the site plan. FEMA’s
flood insurance rate map for this area of Barnstable identifies this area as flood Zone X
(Unshaded), as shown in (Figure 4). The site is not within a priority or estimated habitat.
3.0 Proposed Project Activities
Proposed Project
The proposed project consists of constructing a dwelling with a detached two-car garage/carriage
house, a pool with surrounding patio, a pool equipment shed and an access driveway with

appurtenant utilities. All the development is at the north end of the site other than the access
driveway. The majority of the proposed development is outside of the 100 ft buffer and
Conservation jurisdiction.
A portion of the proposed access driveway is within the 0-50 foot buffer zone. This is the only
access location from Daffodil Lane to the upland portion on the north end of the lot. The proposed
driveway is positioned as close as possible to the easterly property line of the lot, providing as much
separation from the IVW as possible. The driveway layout swings out of the 50 ft buffer as soon as
possible. It is proposed as narrow as is feasible for safe access, being 10 ft wide with a narrow
shoulder. The driveway slope coming in is 10% to keep the required fill to a minimum, with the side
slopes placed at 2:1 to again minimize the footprint of the driveway construction. The steep portion
of the driveway is proposed to be paved as this will minimize the potential for erosion and sediment
transport along the driveway surface and edges. Additionally, the driveway is cross sloped away
from the wetland area. We have created a small forebay area to the east of the driveway (opposite
side of the wetland) which is formed by the driveway fill and natural topography. We have designed
a beehive grate approximately one foot above the low point in this forebay. This will act as a natural
settling and infiltration area for the driveway runoff to enhance the water quality. Larger storm
events will pond and then pass through the beehive grate and culvert at an attenuated rate. After
construction, the side slopes of the driveway will be revegetated with a riparian seed mix to mitigate
the disturbed side slopes and provide habitat area and erosion control.
Other the driveway, only a small portion of the pool patio and the pool equipment shed, are within
the outer area of 50-100 foot buffer zone. The main house, detached garage/carriage house and pool
are all placed outside of the 100 ft buffer zone. This proposed development layout was done to
expand and keep intact more existing vegetated buffer from the IVW providing at least 70 ft from
the IVW
Impact Mitigation
The entire 50 ft buffer is currently vegetated. BN has designed the driveway, as the only point
of access to the site, so as to minimize the impact in the 50 ft buffer. Upon completion of the
driveway construction, the side slopes of the driveway will be revegetated with a riparian buffer
seed mix to provide habitat and stabilization. The side slopes will be allowed to re-naturalize.
Additionally, we have maintained at least a 70 ft buffer from the IVW where we are outside of
the driveway. The permanent impact by the driveway is 2,090 sf and the enhanced/widened
buffer maintained outside of the 50 ft buffer provides an additional 5,582 sf of expanded buffer.
The 50 ft buffer will be fully and naturally vegetated other than the driveway access.
Additionally, the driveway design noted above will mitigate impact from the driveway as to
runoff, erosion and water quality.

4.0 Regulatory Compliance
BN believes that the project will serve the interests of both the Massachusetts Wetlands Protection
Act (MWPA)(M.G.L. c.131 §40) and Town of Barnstable Wetlands Protection Bylaw (Chapter
237).
Isolated Vegetated Wetland and its Performance Standards
According to 310 CMR 10.55, Vegetated Wetlands are likely to be significant to public or private
water supply, to ground water supply, to flood control, to storm damage prevention, to prevention
of pollution, and to the protection of fisheries and wildlife habitat.
The proposed single-family home project will require no direct alteration of the IVW. The only
impact inside of the 50 ft buffer is for the necessary driveway access. The minimized footprint and
the design to address runoff, water quality and stabilization meets the intended performance
standards.
The applicant is requesting a waiver from Chapter 704 requirements, as the driveway construction
will occur in the fifty-foot buffer zone to a wetland resource.
BN believes that all Chapter 237 wetland interests are protected as the project is designed,
specifically:
1) the project will result in no significant adverse impact to public or private water supply;
- the site is not within a water supply area.
2) have no impact on flood control or groundwater;
- the site is not within a FEMA flood zone; additionally stormwater is properly
controlled and groundwater recharge is provided as currently exists.
3) wildlife habitat values will not be significantly impacted;
- given the existing characteristics of the project area and the adjacent wetland
resource, the driveway design will allow wildlife to easily travel and cross the
driveway; the slopes will be revegetated with appropriate buffer vegetation providing
habitat and stabilization along the slopes.
4) the inclusion of appropriate barriers between the project footprint and the wetland resource
areas, as well as the nature of the proposed design and revegetation, serve the erosion and
sedimentation control interests.
5) historical values and recreational interests are not applicable.
Similarly, with respect to the Massachusetts Wetlands Protection Act (MWPA), it is BN’s belief
that this project serves the applicable WPA interests including public or private water supply,

ground water supply, flood control, storm damage prevention, the prevention of pollution, and the
protection of fisheries and wildlife habitat.
As this project is single-family home-associated, the area under consideration for practicable
alternatives is limited to this property. Due to the configuration of the property, and location of
the wetland and buffer zones at the site, the area available for an alternative driveway location
is absent.
Summary
For reasons discussed above, BN believes that this wetland buffer zone project does provide for
the protection of the interests, as none of the proposed activities to occur in the wetland buffer
zone will diminish to any significant degree the ability of any of the wetland resource areas to
provide the ecological functions and services that they currently do.
BN believes that the project does serve the stated interests of both the MWPA and the Chapter
237 Wetlands Protection By-law.
BN believes that this project is eligible for an Order of Conditions approving the project, as all
applicable resource area General Performance Standards are met and the proposed work and
revegetation within the buffer zone will contribute to the protection of the Massachusetts Wetlands
Protection Act and the Chapter 237 Wetlands Protection By-law interests.
