Dear Ms. Karle:
On behalf of the Applicant, Rushy Marsh Realty LLC, Tetra Tech is pleased to submit this Notice of Intent
(NOI), to the Barnstable Conservation Commission pursuant to the Massachusetts Wetlands Protection Act
(WPA) M.G.L. Ch. 131, Section 40 and its regulations (310 CMR 10.00 et seq.), and the Town of Barnstable
Wetlands Protection Bylaw (Ch. 237). Under this NOI filing, the Applicant proposes to construct a small patio
on the landward side of the existing beach cabana at 1500 Main Street within Land Subject to Coastal Storm
Flowage (LSCSF) and within Coastal Bank (State) and its associated buffer zones.
The work is proposed partially within DEP Bank and the Town’s “50 FT Buffer Zone” for which we are
requesting a waiver of performance standards. In addition, dune restoration within Coastal Beach is proposed
as mitigation. A complete description of the proposed activities and mitigation is provided in the attached
Project Narrative and supporting submittal materials.
Enclosed please find two (2) copies of the full NOI Application with full-size (24x36) stamped original plans
and seven (7) additional copies. Also included are two (2) checks, one for the Town portion of the state filing
fee and one for the Chapter 237 filing fee. We respectfully request that you place this matter on your agenda
for the next available public hearing. Notice has been provided to abutters anticipating an October 3, 2023
hearing per the Commission’s 2023 Hearings Schedule Filing Deadlines.

Step 2/Number of Activities: Identify the number of each type of activity.
Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in

1.0 PROJECT DESCRIPTION
The Project is located at 1500 Main Street in Cotuit (Parcel 017-014) and consists of construction of a small patio
on the landward side of the existing cabana and associated landscape and dune restoration mitigation within
areas subject to Conservation Commission jurisdiction. The improvements are collectively referred to as the
“Cabana Patio Project” and their general locations are shown on Figure 1 – Site Locus Map. Proposed work is
detailed on the Notice of Intent Plans (Plans) provided under separate cover and in figures attached at the end of
the narrative.
The Project is comprised of two components, the “Patio” and “Dune Restoration” which are described as follows.
Patio -The Patio is a 25’ x 25’ landscaped area arranged around the base of the existing cabana stairs
and surrounded by a granite block seating wall. The work includes reconfiguration of the walking path to
provide a safer transition from the lawn area above by incorporating individual granite block steps into the
natural slope.
Dune Restoration -The Dune Restoration is a continuation of past efforts to extend/re-establish healthy
dunes along the wide expanse of costal beach extending from the home to the Nantucket Sound. The
work includes planting American Beach Grass in 12-inch layer of sand fill. The proposed restoration
methodology was developed based on results of past restoration attempts and test plots which clearly
show the sand fill yields the best results. The specific improvements and justification are described in
later sections.
2.0 WETLANDS and HABITAT
As noted above and shown on the plans, the Patio work is proposed in areas subject to Conservation
Commission jurisdiction. Those areas include Land Subject to Coastal Storm Flowage (LSCSF), Coastal Bank
(state) and associated buffer zones. The limit of LSCSF was determined based on the lateral extent of the FEMA
VE Flood Zone and is shown on the plans at elevation 14.8 (NGVD29) as converted from FEMA elevation 14.0
(NAVD88). The limits of bank and associated buffer zones are shown on the Plans. The Patio work has been

designed to avoid areas considered Town Bank and there are no inland resource areas within the vicinity of the
Project.
The proposed patio area is located approximately 100 feet from the edge of an area designated as Estimated
Habitats of Rare Species and Priority Habitats of Rare Wildlife (PH2156) on the most recent MassMapper and as
such will have no impact.
The Dune Restoration is located within Coastal Beach, a portion of which extends into the area designated as
Estimated/Priority Habitat. The dune restoration work is intended as a habitat/resource area enhancement offered
as mitigation for patio-related work within the buffer zone as required by the Barnstable Wetlands regulations and
is being coordinated with the Massachusetts NHESP to ensure no unanticipated impacts.
Locations of NHESP polygons are noted on the plans shown on Figure 2 – NHESP Mapping.
3.0 PROPOSED ALTERATIONS
WITHIN LSCSF (and partly within DEP BANK)
The following additional hardscape work is proposed within LSCSF and partly in DEP Bank:
Granite Pavers/Walls/Stairs – 110 square feet of granite wall, patio pavers and stairs is proposed within
LSCSF.
Wood Deck – 45 square feet of patio area will be open joint wood decking.
WITHIN 0’ TO 50’ BUFFER ZONE
The following additional hardscape work is proposed inside the 0’-50’ buffer zone:
Granite Pavers/Walls/Stairs – 184 square feet of granite wall, patio pavers and stairs is proposed within
LSCSF.
Wood Deck – 137 square feet of patio area will be open joint wood decking.
WITHIN 50’ TO 100’ BUFFER ZONE
No hardscape improvements are proposed in the 50’-100’ Buffer Zone. The only work proposed in this area is
planting of 21 Boxwood bushes to increase overall vegetation density in the buffer zone.
The improvements described and corresponding changes are shown on Figures 3E and 3P and summarized in
Table 1 which are attached at the back of this memorandum.
4.0 ALTERATION AND MITIGATION SUMMARY
The Project will result in 476 square feet of additional hardscape inside the 50’ buffer zone (4:1 mitigation) and no
changes in the 50’-100’ buffer zone (3:1 mitigation). Applying mitigation ratios of the Barnstable Wetland
Regulations the Project requires 1,904 square feet of mitigation planting.
The Project proposes to meet this mitigation requirement and offset any negative impact of the proposed
improvements through a three-pronged program of mitigation comprised of the following elements.
Supplemental Landscaping - The Project proposes an extensive program of carefully selected native
landscape improvements to offset its minor impacts. The Project will install 22 new evergreen trees to

offset the 10 removed and to supplement existing woodland. The mitigation program will also include a
mixture of low-maintenance native shrubs and smaller plants intended to increase vertical diversity.
Dune Restoration (Required) - The proposed Dune Restoration is a continuation of past efforts to
extend/re-establish healthy dunes along the wide expanse of costal beach extending from the home to
the Nantucket Sound which has included varying restoration strategies with substantially different results.
Past strategies included (1) direct beach grass planting, (2) beach grass planting in 12-18’ sand fill and
(3) beach grass planting with calcium sand enrichment. The strategy of calcium enrichment was
developed following soil testing performed by Pine and Swallow to better understand generally lackluster
results of initial restoration efforts (Method 1) in comparison to the relatively positive success of planting in
sand fill (Method 2). Method 2 has proven to be the most successful restoration strategy both in
application and in test plots and clearly demonstrated in recent aerial photographs (see attached Figure
5). As such, the Project proposes to extend the Method 2 restoration in both a landward and seaward
direction to create a more expansive and uniformly successful restoration of the area as shown on Figure
6. A distinct goal of this restoration is to create a more naturalized dune footprint to remedy the unnatural
footprint resulting from previous restoration efforts which is clearly visible in photos. To that end the actual
limits of restoration will be determined in the field by the Project Landscape Architect and coordinated
with the conservation agent prior to start of construction.
Dune Restoration (Discretionary) -The Discretionary Dune Restoration is an area of restoration the
Project hopes to complete concurrently but is unable to commit to. The Project seeks authorization from
the Commission to complete this work with the understanding that it is not required mitigation. We
anticipate the discretionary work will be performed concurrently with the required work to minimize
construction impacts and all work will be coordinated with the conservation agent prior to construction.
In total 1,526 square feet of mitigation planting will be provided, nearly meeting the Project mitigation requirement
on its own. In addition, the Project commits to 8,890 square feet of Dune Restoration resulting in a 22:1 mitigation
ratio and exceeding the area required by 5X and a 36:1 mitigation ratio (8.5X) if the discretionary portion is
included.
Project alteration and proposed mitigation is summarized in Tables 1-3 provided at the end of this narrative.
5.0 EROSION AND SEDIMENT CONTROLS
The Project will mobilize construction from the existing driveway area (outside the buffer zone) and will install and
maintain construction period erosion and sediment controls to contain the work zone and minimize risk of
sediment migration or inadvertent impacts to protected areas. Construction period erosion and sediment controls
include proven methods for managing runoff such as filter sock perimeter controls and temporary sediment traps.
Surface runoff in and around the work will be directed toward the existing cabana foundation where water will be
allowed to infiltrate into the ground resulting in very little if any anticipated runoff during construction. All
earthworks will be performed per a prescribed sequence including interim surface stabilization to prevent erosion
and filter sock perimeter controls. Specific controls are shown on the Existing Conditions, Demolition, and Erosion
& Sediment Control Plan (Sheet C-1 of the Plans).
6.0 WORK PLAN
The following describes the expected work sequence and associated measures taken to prevent migration of
sediment beyond the work area or other collateral impacts to resource areas or buffer zones.
1. Notify Conservation Commission (ConCom) and file required forms prior to construction.
2. Install erosion and sediment control measures per approved plans.

3. Notify ConCom that erosion controls have been installed and allow for inspection.
4. Clear area of proposed work including removal of American Hollys designated for replanting.
5. Protect trees to remain and perform required excavation and removing any excess material.
6. Construct patio walls and stairs.
7. Install patio landscaping.
8. Install finish patio walking surfaces and balance of landscape and mitigation plantings.
9. Remove erosion and sediments controls and demobilize from site.
All work will be performed under the strict supervision of experienced construction managers familiar with working
conditions at the site and who understand the performance expectations of the Conservation Commission and its
agents. We are confident the measures described above ensure adequate protection of the wetland resource
areas and associated buffer zones.
7.0 CONSISTENCY WITH INTERESTS OF CHAPTER 237 AND WETLANDS PROTECTION ACT
The Project is completely consistent with, or otherwise supports, the interests identified in Chapter 237 of the
Barnstable Bylaws and the Wetlands Protection Act and its regulations under 310 CMR 10.00 including the
following performance standards noted in Chapter 704:
Pollution Prevention: This Project is part of the continued improvement and environmental stewardship of
the Rushy Marsh Farm property and seeks to improve upland areas of the site while maintaining wetland
resources responsibly and respectfully. Maintenance of the cabana patio and the surrounding landscape
will be included in the home’s diligent facility management program and none of the proposed work or on-
going activities increase the risk of pollution.
Wildlife: The Project will improve a large are of landscaping and restore a large area of costal dune
benefiting wildlife and its habitat.
Cumulative Effects: The Project comprises a very small portion of a large predominantly undeveloped site
and consists of minor and extremely narrow impacts resulting in no discernible cumulative effects.
Storm Damage Prevention/Flood Control: The project includes appropriate and adequate controls for
management of stormwater both during and after construction. The Project will not impact flood control
nor present any risk that any capacity to prevent storm damage will be compromised in the future.
Coastal Bank Performance Standards (310 CMR 10.30): The Coastal Bank is well-vegetated and over
500 feet from mean annual high tide and does not supply sediment to the coastal beach, coastal dunes,
or barrier beaches. The proposed work will not negatively impact either the height or the stability of the
bank.
Land Subject to Coastal Storm Flowage (LSCSF): The Massachusetts Wetland Protection Regulations
have no performance standards or restrictions for work within or around LSCSF. The project complies
with the Barnstable Guidelines for Activities in Land Subject to Coastal Storm Flowage.

Regulation Governing Minimum Submission
Requirements for a Notice of Intent Application
The Barnstable Conservation Commission has adopted the following requirements in order to obtain more
consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent
(NOI) applications. Failure to complete any of the items in this checklist may result in your application being
denied.
Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain
instances, like field staking, denoting that the task will be completed. The following submission checklist covers the
requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of
Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application.
1.Requirements
a.The applicant understands, unless they’ve instructed otherwise, they are applying both
under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and
Chapter 237 of the Town of Barnstable General Ordinances.
b.Attach a written narrative to the NOI application (WPA Form 3), available at:
www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html
describing any project impacts and proposed mitigation as they relate to the following:
1)Any of the interests of Chapter 237 of the General Ordinances and the MassDEP
Wetlands Protection Act M.G.L. 131, §40.

planting plan shall include species list (chosen from the Town of Barnstable Conservation
Commission approved planting lists), sizes, densities and/or quantities. The plan shall
also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of
mitigation planting required, and the amount of mitigation planting proposed.
e.Provide detailed, written street directions to the locus (site).
f.Provide a copy of a U.S.G.S. locus map indicating the general area of the project site.
g.Provide a check for the Town of Barnstable portion of the required filing fee. (The portion
payable to the Commonwealth, see 7. e. below)
h.Provide any other documentation, photographs, architectural renderings or other supporting data
prepared by professionals competent in the field which may be relevant to the application.
6.The site plan shall also show:
a.All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred).
b.Clear delineation of all existing and proposed structures and features. Building structures must
be accurately dimensioned (fixed location) from property lines and wetland resource a reas. Plans
shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory
areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On
complicated sites, existing and proposed conditions must be shown on separate sheets.
c.Locus inset map of the site clearly showing its location relative to surrounding public streets.
d.All wetland resource area flags by individual flag number (matched to the field) to clearly
identify all resource areas on or within 100 feet of the work area. The individual who performed
the flagging and date of flagging shall be identified on the plan next to the resource line.
e. Section views showing changes in grade, cuts and fills.
7.SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS:
a.Provide a signed Permission to Access Property, Form PA. The form must be signed by the property
Owner, or legal representative and submitted prior to NOI being docketed and application advertised .
