HomeMy WebLinkAbout10-20-2023 - Lt Laura CroninLaura Cronin 402 South Street Hyannis, MA 02601 508-776-8259 ltftmc@hotmail.com Town of Barnstable - Planning Board October 20, 2023 367 Main Street Hyannis, MA 02601 RE: Regulatory Agreement – Shoestring Properties, LLC: Dockside Condominiums Mr. Steve Robichaud, I am writing to you concerning the item on your agenda, Regulatory Agreement for Shoestring Properties, LLC 110 School Street, and 115 School Street. I oppose this project as presented in the updated plans and materials on the Town website for this meeting on October 23, 2023. I have spoken before and have been consistent with my concerns of this project about density, height, and number of stories for the Hyannis Harbor district. Nothing has changed. The proposed project is still outside of the current/ updated zoning, and still seeks significant waivers. The recent Town of Barnstable’s Form Based Zoning update did not change the Hyannis Harbor District zoning regarding density, height, and number of stories, which remains at 35.0 Ft and 2.5 stories, respectively. The proposed development significantly exceeds the Town’s density zoning, which remains at 7 per acre; this proposal is an overall 28 per acre, which is 75% more than the current zoning for the Hyannis Harbor district. It is still over 4 1/2 stories, ( >44% more than current zoning only allows 2.5 stories), and the height of the two buildings at 60.08 ft and 58.58ft, is over 41% of the current zoning of 35.0 ft. (and from the waterfront view is over ~ 6 stories). On January 23, 2023, this Board saw fit to follow the current zoning ordinances when it rejected this proposal as it is too large for this location, and zoning. Nothing has changed with respect to density, height, and number of stories. I am respectfully asking that you reject this proposal, as it is still outside of our current updated zoning for the Hyannis Harbor District. At the last meeting, Mr. Kenny repeatedly disparaged the Hyannis Main Street Waterfront Historic District Commission (HMSWHDC), the integrity of its members; as well as members of the public who spoke against the project because of the waivers being sought. I am shocked and disappointed that such disregard for a sitting board and the public, can be consistently attacked by this developer and their attorneys, every time they present a project which seek significant waivers, and/or requires approval of appropriateness withing the Hyannis Harbor historic district. Mr. Kenny also mentioned a project this developer brought before HMSWHDC in which he stated they were treated unfairly. I urge all board members to review for yourself, the videos from the HMSWHDC June 7, 2023, meeting of where and why this developer was denied a certificate of appropriateness for a proposed Marine Storage facility; and the subsequent July 18, 2023 Hyannis Main Street Waterfront Historic District Commission Appeals Committee meeting, where they upheld the original historic decision; and assess whether or not either commission acted unfairly, unprofessionally or not committed to executing their assigned responsibilities. This developer has had these properties for over 25 years and chose to leave them in various states of disarray, or undeveloped over the many years. They have the option to build something great for Hyannis, and its Historic Waterfront within the existing “By Right” zoning and choose not to, which is his right, but unfortunate.
