If your answer is yes, then please refer this project to the HMSWHDC. o As Mr. Kenny indicated, Regulatory Agreements are all about compromise...the applicant compromises and the town waives zoning and supposedly receives considerable benefits in return. o If this building was 3.5 stories, it would still require waivers from the town, which the town may consider, as a compromise with the applicant for reducing it by one floor. o Did you know that School Street North of South St (across the street from this proposed building) 4-stories are not allowed? I don’t believe staff or Mr. Kenney indicated that in the information you received. (I understand the zoning is new, and it’s hard to remember every detail) o If this building was 3.5 stories, and went before the HMSWHDC, I would support it and drop my opposition to the project. o The granting of waivers is not based on the age of an applicant, or past investments the applicant has made here and elsewhere. o I hope you will consider asking the applicant to redesign it to 3.5 stories so it is brought into scale with the general area. (It would still be 13-14’ taller than what is allowed. People would still see it high on the hill from afar!) o I hope you will consider referring the applicant to the Hyannis historic review committee, just as you would any prospective building in your village historic district. Hyannis residents deserve the same respect as other villages in town. Thank You for your consideration.
