The regularly scheduled Barnstable Licensing Authority Public Meeting was called to order at approximately 3:00
p.m. on Monday, July 24, 2023 and was held at Barnstable Town Hall, 2nd Floor Hearing Room, 367 Main Street,
Hyannis.
Members Present: David Nunheimer, John Flores, Nancy Karlson-Lidman
Members Absent: Larry Decker, Max Mitrokostas
Staff Present: David Anthony, Director of Asset Management; Consumer Affairs Officer Chris Kelsey;
Erin Logan, Interim Deputy Director of Asset Mgmt and Licensing

NEW BUSINESS
1. Amend All Alcohol Club License An application has been filed by Hyannis Yacht Club, Inc. dba Hyannis
Yacht Club, 490 Ocean Street, Hyannis for two amendments (1) Amend Directors and Officers as per
schedule 6 of the application on file. (2) Change of Manager from Robert Signoriello to Emily Mezzetti.
Continued from July 10, 2023
Emily Mezzetti was present and advised that the officers needed to be updated in order for the change
of manager to be approved by the state.
MOTION: Nancy Karlson-Lidman moved, seconded by John Flores, that the Licensing Authority approve
this application as submitted.

2. Amend All Alcohol Common Victualler An application has been filed by Nonno Pizza Inc. dba Nonno
Pizza, 640 Main Street, Hyannis to change the hours of operation FROM daily, 11:30 a.m. to 10:00 p.m. TO
Monday through Saturday 11:30 a.m. to 1:00 a.m. and Sunday 11:30 a.m. to 11:30 p.m.
Attorney David Lawler was present to represent the application. The applicant proposes to change the daily
hours of operation.
MOTION: Nancy Karlson-Lidman moved, seconded by John Flores, that the Licensing Authority approve
this application as submitted.

An application has been filed by Provo Brazil Steakhouse LLC dba Torino Restaurant & Bar, 415 Main
Street, Hyannis for two amendments. (1) Change the corporate name from Provo Brazil Steakhouse LLC
to Torino Restaurant & Bar LLC; and (2) alteration of premise description will be expanded to include
outdoor roof bar area. Continued from July 10, 2023
Attorney John Kenney is present. The company changed the name back in 2017 and am amendment was
submitted to the Secretary of the State but the license was never updated. The second matter is to add the
roof deck to allow for dining, weather permitting. There is no change to the number of seats as they will
block off a private room inside to allow use of the rooftop. Nunheimer confirmed the roof deck will operate
at the same hours as the restaurant. No entertainment on the roof, just dining. Karlson-Lidman confirmed
with Attorney Kenney that there will not be any piped in music on the patio. Officer Kelsey has some
concerns with dining on the roofdeck after 9:00 pm at night. He is concerned that the noise will carry
resulting in noise complaints. Attorney Kenney consulted with his client. The Kitchen closes at 10pm and
they ask if they would agree to 10pm. Officer Kelsey is concerned that likely patrons will be around until
11pm finishing a meal. Fabio De Oliviera is present and notes that the kitchen is open until 10pm. Flores
suggests stopping orders on the deck at 9pm. Nunheimer suggests no alcohol service after 10pm. Seating
until 930pm, nothing after 10pm. Nunheimer advises if there are noise complaints they will be asked to
come in. Flores suggests serving until 930 with patrons off the deck by 1030. Officer Kelsey agrees.
MOTION: Nancy Karlson-Lidman moved, seconded by John Flores, that the Licensing Authority approve
this application as amended to allow patrons to entry the rooftop deck up until 930pm and must vacate
after 1030pm, no alcohol service after 10pm.

4. Amend Wine & Malt Common Victualler License & New Daily Live Entertainment License
An application has been filed by Palio P Inc dba Palio Pizzeria, 435 Main Street, Hyannis for (1) an
alteration of premise application amending the premise description to include additional seating on the
expanded outdoor patio & (2) a New daily live entertainment license to include live amplified music with
a maximum of 4 performers, 4 pieces on the outdoor patio from 12:00 p.m. to 9:00 p.m. daily. Continued
from July 10, 2023
Paulo Paraguay, amending wine and malt liquor license to reflect an update in seating capacity. Additionally,
they are looking to apply for an entertainment license outside only for summer months and special events
such as Hyannis Open Streets and First Fridays. Officer Kelsey confirmed with Paraguay that the
entertainment will cease at 9:00pm nightly.

this application as submitted.

5. Amend All Alcohol Common Victualler, New Daily Live and Daily Non -Live Entertainment licenses
An application has been filed by Dubh Linn LLC dba British Beer Company, 412 Main Street, Hyannis to (1)
amend the daily non-live entertainment license to include 4 TV’s and to amend the daily live
entertainment hours from 9:00 p.m. - 12:45 a.m. to 10:00 a.m. - 12:45 a.m (2) amend Sunday opening
alcohol service hours from 11:00AM to 10:00AM. Continued from July 10, 2023
Attorney John Kenney is present looking to amend the daily non-live entertainment to include 5 TV’s though
the advertisement stated 4. Additionally, they propose to amend the alcohol service hours.

this application as submitted.

6. New Farmer Brewery Pouring License
An application has been filed by Oak Bay Brewery LLC, 606 Main Street, Hyannis for a new Farmer
Brewery Pouring license, malt only, as well as a new common victualler license to include indoor and
outdoor seating. Continued from July 10, 2023
Application was represented by Brian Poulin small restaurant and small batch brewery Federally and State
licensed to brew on site. The kitchen is set up with sandwiches and light fare food. Karlson-Lidman asked if
there will be a brewing tour.

this application as submitted.

7. Renewal - Special One Day Entertainment Only
An application was filed by The Hyannis Sound (The Boys of Summer) to hold Hyannis Sound Alumni
Concert 2023 at the Hyannis Town Green, on August 5, 2023 from 6:00 p.m to 9:00 p.m. This is a live
amplified music event.
8. Renewal - Special One Day Beer & Entertainment
An application was filed by Cape Cod Maritime Museum, 135 South Street, Hyannis, to hold a 4th
installment of “History on Tap”, a series of living history demonstrations with samples of local breweries
to be held on August 14, 2023 from 5 p.m. to 7 p.m., beer will be poured by Castle Island Brewery.
9. Renewal - Special One Day Beer & Entertainment
Four applications were filed by Sturgis Library, 3090 Main Street, Barnstable, for the September Music
Series for the following dates and times: (1) Mike Machaby and the Movers, September 9, 2023 from 2
p.m. to 3:30 p.m. (2) Greg Loftus, September 16, 2023 from 2 p.m. to 3:30 (3) Willie J. Laws, September 23,
2023 from 2 p.m. to 3:30 (4) Molly Parmenter and Dave Ellis, September 30, 2023 from 2 p.m. to 3:30 p.m.
10. Added Participant for the First Fridays Event – Special One Day Beer & Wine License
Five applications were filed by Hyannis Public Library – Ora’s Parlor Bookshop, for five, one-day Beer &
Wine licenses as part of the Hyannis Business Improvement District First Friday’s events. The applicant is
requesting to serve beer and wine at the previously approved First Friday events to be held on 8/4/23,
9/1/23, 10/6/23, 11/3/23, and 12/1/23. Current site plan, security plan and TIPS certification is on file.
11. Renewal - Special One Day Beer & Wine
An application was filed by The Barnstable Historical Society to hold Summer Splash at the Barnstable
Comedy Club located at 3171 Main Street, Barnstable on August 13, 2023 from 4 p.m. to 6 p.m. This is a
fundraising event for the Barnstable Historical Society with 125 anticipated attendees. Current TIPS
certificates on file.
MOTION: Nancy Karlson-Lidman moved, seconded by John Flores, that the Licensing Authority accept the
consent agenda as submitted.

APPROVAL OF MINUTES
MOTION: David Nunheimer moved, seconded by Nancy Karlson-Lidman, that the Licensing Authority
approve the May 1, 2023 Minutes.
