Dear Chairman Lee and Barnstable Conservation Commissioners,
On behalf of the applicants, Donald L. and Eileen Beaulieu, Marsh Matters Environmental (MME) submits
the enclosed Notice of Intent (NOI)(WPA Form 3), project site plan set, mitigation planting plan, site locus
figures, existing conditions photos, and other supporting documents seeking an Order of Conditions (WPA
Form 3) approving the raze and rebuild of a single-family residence located at 350 Sandy Neck Road in West
Barnstable, Massachusetts (the Site). MME submits this NOI pursuant to the Massachusetts Wetlands
Protection Act (“MWPA”)(M.G.L. Ch. 131 §40) and the Town of Barnstable Wetlands Protection Bylaw (Ch.
237), and in accordance with the implementing MWPA Regulations (310 CMR 10.00) and the town’s
Regulation Governing Minimum Submission Requirements for a Notice of Intent Application. Please accept
this cover letter as the proposed project narrative.
Existing Conditions
The Site is a 1.12-acre property located in a residential neighborhood along the road to Sandy Neck Beach
in West Barnstable (site locus figure set in NOI Attachment 1). On the property is a seven-room house,
which was originally constructed in 1965 according to the town’s property records (existing conditions
photos in NOI Attachment 1). A detached garage and small shed also exist on the lot. The entire property is
located outside of the coastal floodzone (Zone AE – EL. 13)(Figure 4) and outside of the one-hundred-foot
buffer zone to the nearest coastal resource area, which is a Coastal Bank.
Located east of the house is a small, man-made basin depression, which has served as a collection area for
stormwater roof-runoff (via buried pipe) and over-land sheet flow and may have been originally excavated
for use as part of farming operations long ago (see photos 3 and 4 in Attachment 1). As this basin supports
a predominance of hydrophytes and periodically holds water, this feature conforms to the Chapter 237
definition of freshwater wetland. In 2014, the previous owner (the J.K. Russell Trust) filled this depression
without permission and was required to reestablish the basin (see BSC plan Attachment 3). That work was
completed in 2015. The Beaulieus purchased the property in 2020.
Proposed Project Activities
The enclosed project plan (Site Plan, prepared by JC Engineering, Inc., 11.8.2023) illustrates both existing
conditions and proposed conditions (NOI Attachment 2). A second plan provides architectural elevation
drawings and floorplans (by ArchiPlicity, LLC, 9.13.2023). A third exhibit is a mitigation planting plan, which
is a supplement to the primary site plan, providing details as to how the project meets Chapter 704-3(D)
requirement for activities in the 100-foot resource area buffer zone by the addition of native plantings
between the resource area and proposed activities (prepared by MME, 11.10.2023).

The reconstructed residence will be a new, four-bedroom, two-story dwelling with an attached garage. The
entire structure footprint will sit further from the isolated wetland than the current footprint due to the
reconfiguration of the deck at the southeast corner of the house. The proposed net addition of structure
and hardscape is 455 SF, and all new structure is located on the upland side of the existing house in the
outer fifty feet of the 100-ft buffer zone to the isolated wetland or outside of the buffer zone. According to
calculations provided by JC Engineering, 1,361 SF of mitigation is required. Mitigation proposed is 1,400 SF.
No changes to the existing on-site sewage disposal system are necessary. There will be no removal of any
naturally occurring vegetation and grade changes are minor. Five stormwater infiltration chambers will be
installed to collect and infiltrate roof run-off.
Regulatory Compliance Opinion
The house design removes existing structure from the 50-ft buffer zone and only adds new structure on the
upland side of the existing house in the outermost portion of the buffer zone to the isolated wetland.
Implementation of the proposed mitigation planting plan will increase the amount of native vegetation
between the house and small wetland area. The amount of mitigation meets the Chapter 704-3(D)
requirements. For these reasons, MME believes that the proposed project serves all MWPA and Chapter
237 interests and is eligible for an Order of Conditions approving the project as currently designed.
MME attests that it will send written notification of this project application and the public hearing date of
November 28, 2023, to all property abutters on the date of this filing. MME has enclosed checks to cover all
application filing fees. A digital copy of this application package will be provided to you and to MassDEP as

Fee should be calculated using the following process & worksheet. Please see Instructions before

Step 1/Type of Activity: Describe each type of activity that will occur in wetland resource area and buffer zone.
Step 2/Number of Activities: Identify the number of each type of activity.
Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 6/Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To
calculate the city/town share of the fee, divide the total fee in half and add $12.50.
