Thomas Lee, Chairman Barnstable Conservation Commission c/o the Town of Barnstable Regulatory Division / Conservation 230 South Street Hyannis , MA 02601 RE: REVISED PLAN SUBMITTAL NOTICE OF INTENT – SINGLE-FAMILY RESIDENCE RAZE AND REBUILD 350 SANDY NECK ROAD, WEST BARNSTABLE APPLICANTS: DONALD & EILEEN BEAULIEU Dear Chairman Lee and Barnstable Conservation Commissioners, On behalf of the applicants, Donald L. and Eileen Beaulieu, Marsh Matters Environmental (MME) submits two copies of the enclosed revised project plan that includes the addition of a split-rail wooden fence along the landward margin of the proposed mitigation area. The fence has been added at the suggestion of Conservation Administrator Karle in order to clearly define the permitted limit of mowing or other land management activities for the property owner. As you are aware, this property and its previous owner have a Conservation enforcement history involving a wetland fill action and subsequent restoration in 2014 and 2015. The Beaulieu’s, who purchased the property in 2020, were not fully aware of this history and the conservation-related requirements and land management limitations that were transferred with their purchase. Since 2020, the property owner has been maintaining areas near and around the isolated wetland by mowing. They understand the purpose of the split-rail fence and that its installation will be a condition of their project’s approval. With this revised plan, they are asking permission to maintain a low- impact means of permanent access around the isolated, man-made wetland and, therefore, a four feet- wide “soft” footpath along their rear lot perimeter fence has also been added to the plan. MME believes this is a reasonable request and that there will be no impact to the limited ecological functioning of this wetland by maintaining a grass footpath providing access to the rear corner of their property. A digital copy of this revised plan has been provided to your office by email. The legal advertisement cost reimbursement has also been provided as required.
