Hi Darcy;
I've been discussing the shellfish survey with the shellfish guy (John Lowell of East
Dennis Oysters).
He wants to confirm the survey area going out 50 feet; he's concerned that he'll be in
the middle of the river, and that it's cobble out there.
I know we have to go 50' on either side of the work area, but do we have to go 50 feet
out as well?
That's a huge area; 140 samples, at 4 sq. feet per sample, which comes out to double
the .5%.
Can you confirm that we need to go out as well, or just on both sides please?

Please see Chapter 703. It states you need to include a shellfish survey from a
consultant in the applica on. When you file the NOI you will see in the
submission guidelines that you need to also provide copies of the completed NOI
applica on to the Shellfish department and Harbor Master. Once the Shellfish
receives the NOI applica on they will survey the loca on as well and provide
their survey to the Commission for the record.
As a p. When providing addi onal informa on in the NOI packet, go over the
list A-R under § 703-4. Regula ons and address your project in rela on to each
item.

Hi Darcy:
I've a ached a plan for a property on the Centerville River.
He wants to rebuild the dock, extend it a li le, and extend the
exis ng float system about 6 more feet seaward.
The exis ng dock is permi ed and licensed, but the proposed
reconstruc on is not within the licensed footprint.
Since he's not staying within the licensed footprint, I can't use just
the form to authorize the work; I realize he needs an Order of
Condi ons for this type of work.
Is this the type of project that needs a separate shellfish survey? For all of my other projects, the shellfish warden came by on their
own and then reported back to the commission.
Please advise me on whether I need an independent survey so I
can get that before I enter local permi ng.
