The site consists of a developed 91,036 s.f. lot containing 40,854 s.f. of upland area, improved with a garage and 3-bedroom single family dwelling that was constructed in 1985 per assessors' records. The site is bordered to the south and west by a Bordering Vegetated Wetland, Coastal Bank and River. The edge of the Bordering Vegetated Wetland was flagged by Paul Shea of Independent Environmental Consultants. The site is also within Land Subject to Coastal Storm Flowage {LSCSF) Flood Zone AE elevation 13. The site does not lie within Priority or Estimated Habitat in accordance with the latest Natural Heritage map {2017). The proposed dwelling will be constructed on the existing foundation with a new deck, patio, pool, and walkway. The closest point of proposed structures will be 22.1' away from the BVW which is further than existing at 20.1'. A new water line is proposed, and that work will include repairing the disturbed gravel driveway. All construction will take place within existing lawn or developed areas and outside the Inner Riparian Zone. 2000 s.f. of mitigation is proposed to offset the hardscape increase within the Outer Riparian Zone and 100' buffer to the BVW. Removal of invasive species plants throughout the property is also proposed. See proposed mitigation and restoration plan and narrative by Crawford Land Management dated 1/9/2023. A work limit line of staked silt fence is proposed downgradient of all work. 310 CMR 10.30 Coastal Bank A Local and State Coastal Bank exists at the top of the slope above the Flood Zone elevation of 13. The Coastal Bank was delineated in accordance with the Wetlands Program Policy 92-1. All proposed work will be located further away from the bank than existing structures. The bank is stable and vegetated. The added mitigation plantings will serve to provide increased stabilization and mitigate against wind and rain runoff. The staked silt fence will contain all construction activities. The banks ability to contain stormwater will be unchanged by the project. 310 CMR 10.55 Bordering Vegetated Wetland The proposed dwelling will be constructed within existing developed areas. No adverse effects from the work are expected, as the work limit line shall remain staked in place until all work is complete, and the site is stabilized. The BVW will continue to act fully in its capacity to provide habitat and food sources for wildlife. Proposed structures are located further away than existing, and mitigation is proposed to offset the increase in hardscape. 4 land Subject to Coastal Storm Flowage The property is within Flood Zone AE el. 13. None of the proposed construction work will take place within LSCSF. Roof drywells are proposed to infiltrate the roof runoff. No adverse impacts are expected during any flooding event. Riverfront Area {310 CMR 10.58} Rendezvous Creek lies to the southwest of the property. The 100' Inner and 200' Outer Riparian Zones are shown on the site plan. The lot and existing dwelling pre-date the Rivers Act (1996). Section 10.58(5) of the Wetland Protection Bylaw allows redevelopment of a previously developed area, provided the proposed work improves existing conditions. Most of the work will take place within the outer riparian zone aside from some invasive species removal. The proposed work will take place within existing developed areas and will have no adverse impacts on the riverfront area. (a) The lot is previously developed, and the proposed work will result in an improvement over the existing conditions. (b) No additional runoff into the riverfront area will be created with this work. Roof drywells are proposed to handle roof runoff and will also be utilized as a pool drawdown pit. (c) All work will take place within existing developed or landscaped areas and will be no closer than existing to the river. (d) No expansion of existing developed areas is proposed. (e) See (d) (f) A net increase of 543 s.f. of hardscape within the riverfront is proposed. 2000 s.f. of mitigation is proposed. (g) See (f) (h) See (f) Barnstable Wetlands Protection Bylaw (Chapter 237 compliance) 1. Effects on Erosion Control: the work limit line will consist of staked silt fence. This will be installed prior to any work occurring on the site and shall remain in place until all the construction/re-grading has stabilized. The proposed roof drywells will mitigate run-off. 2. Effects on wildlife: The proposed dwelling will not have a deleterious effect on wildlife. This lot is not within Priority or Estimated Habitat of Rare or Endangered Species. All of the work will occur within maintained lawn/landscape area or areas with existing structures. Mitigation is proposed to offset the increase in hardscape within the 100' buffer to the BVW. 3. Effects on Recreational Interests: None expected; this is privately owned property. 4. Effects on Aesthetic Interests. No negative effects. 5. (& 6.) Effects of Agriculture/Aquaculture: N/A 7. Effects on Historic Interests: No archaeological sites are known to occur on the property. Standard excavating equipment will be used for the construction. Any staging areas will be located outside the 50' buffer to the BVW and within the existing driveway area. Mitigation Calculations under Barnstable Chapter 704 This site contains an existing disturbed 50' buffer. The applicant is proposing an increase of 99 s.f. of hardscape within the 50' buffer and an increase of 498 s.f. of hardscape within the 50-100' buffer. 1890 s.f. of mitigation is required and 2000 s.f. of mitigation is proposed. The proposed work, and mitigation calculations are plotted on the enclosed site plan By Down Cape Engineering, Inc. Alternatives Analysis The site could remain as is, but the existing dwelling needs repairs. The applicant would like to build a new structure with more efficient living space. The proposed mitigation will serve to offset the increase in hardscape and the proposed roof drywells will help infiltrate roof runoff. The invasive species and lawn removal will allow for the growth of native species plants and promote a more natural approach to landscape management on the site. PROPOSED PROJECT ACTIVITIES This project proposes several site improvements, including reconstructing the existing dwelling within the same footprint, adding a pool, and reconfiguring existing deck and patio space and walkways. The existing dwelling will be reconstructed on its existing foundation, and the pool, reconfigured decks, patios, and walkways will largely occupy areas of existing hardscape; the limit of work will follow the existing edge of lawn so that no vegetation removal will be necessary for construction activities. More details related to the proposed site improvements can be found on the Site Plan provided by Down Cape Engineering. Mitigation for the proposed site improvements is in the form of removal of lawn and replacement with native shrubs, grasses and herbaceous plant material. In total, 1,890 square feet of mitigation is required for the proposed site improvements, and approximately 2,000 square feet of mitigation is being proposed. The area for mitigation plantings will vegetate as much of the 0-50' buffer to the wetland as possible, as well as portions of the 50-100' buffer. Voluntary restoration work is also proposed with this project, which is broken into three phases across portions of the property. Each phase has a component aimed at managing invasive/non-native vegetation and a component aimed at managing Common reed, which has a slightly different management protocol/ timeline than other species. Phase 1 is focused on the area west of the dwelling in an effort to improve the health of naturalized areas while improving views toward the adjacent wetland from the dwelling. Phase 1 also includes a small stand of Japanese knotweed out toward Freezer Road, which should be managed early to prevent its spread. Phase 2 is focused on improving the health of naturalized areas adjacent to the wetland areas and the road, and on improving views looking out toward the wetland from Freezer Road for the benefit of the surrounding neighbors/community. Phase 3 incorporates the remaining naturalized areas on the property, both along the gravel drive and surrounding the remaining outdoor living spaces in an effort to improve the health of naturalized areas and control the remainder of non-native vegetation on the property. The land management protocol and timeline for Non-Native Species Management and Phragmites Management areas is outlined below. 5 PROJECT ACTIVITY TIMELINE Timing of land management activities is contingent on the construction timeline; the timeline presented below may need to be shifted back depending on the timeline of construction activities. Work that needs to be completed at a specific time of year is marked with an asterisk (*). Phases 2 & 3 are optional, but if completed, should follow the same general timeline in regard to time of year as Phase 1 activities. WINTER/EARLY SPRING 2024 PHASE 1 NON-NATIVE SPECIES MANAGEMENT AREA • Treat and remove all approved invasive, non-native or aggressive vegetation using an appropriate herbicide (Glyphosate-based or Triclopyr-based) using a cut and wipe method. Vegetation to be flush cut leaving the roots in place to maintain soil stability. Seed all exposed soils with the specified Restoration Seed Mix and cover with a thin layer of clean hardwood wood chips or hydro-seed with the ProGanics biotic soil media/FlexTerra erosion control system. Rejuvenate any native shrub specimens uncovered in the restoration area, if needed, with regenerative pruning techniques to encourage new, dense growth. * PHASE 1 PHRAGMITES MANAGEMENT AREA Cut and remove dead stalks prior to the start of the growing season to facilitate the treatment process later in the growing season. SPRING OR FALL 2024 SITE PREPARATION WITHIN THE CONSTRUCTION LIMIT OF WORK After construction work is complete, a soil compaction meter will be used to determine if soils remain over-compacted by construction activities. If so, soils will be ripped to de-compact until compaction meter readings are acceptable. The area will be fine-graded, raked smooth and prepared for seeding or planting with specified materials. MITIGATION & PHASE 1 RESTORATION PLANTINGS Mitigation plantings are to be installed once construction and site preparation activities are complete. Restoration plantings may be installed once invasive species have achieved at least 80% control. Install a temporary, above-ground irrigation system after planting to provide supplemental water to all plantings for 2-3 growing seasons or until plants are fully established. LATE SUMMER/EARLY FALL 2024 * PHASE 1 PHRAGMITES MANAGEMENT AREA Where stalks occur densely enough, bundle, cut and treat cut ends using a Glyphosate-based herbicide specially formulated for use around aquatic environments. If stalks are sparse, cut stalks individually and treat with an appropriate herbicide. If stalks are too small to cut and treat, use a swipe method to apply an appropriate herbicide to the stalks and leaves. *JAPANESE KNOTWEED MANAGEMENT AREA • Treat stalks using a stem injection method with a Glyphosate-based product between the nodes inside the stem. 6 WINTER 2024/EARLY SPRING 2025 * PHASE 1 PHRAGMITES MANAGEMENT AREA Cut and remove old/dead stalks and dispose of off-site. *JAPANESE KNOTWEED MANAGEMENT AREA Cut and remove old/dead stalks and dispose of off-site. 2024-2026 GROWING SEASON ANNUAL MAINTENANCE Monitor mitigation/restoration areas and perform maintenance cut and wipe treatments or hand weed invasive, non-native, or aggressive species that have germinated from existing seed bank or re- sprouted from roots after removal. Manage re-growth of Phragmites stalks over the following seasons using a swipe method or low- volume foliar spray to apply herbicide to the stalks and leaves, ideally in the late summer or early fall. Complete follow-up treatments of Japanese knotweed for several growing seasons to achieve complete eradication. Knotweed which has grown back in a witch-broom-like manner should be treated with a foliar application method on an as-needed basis with a Glyphosate-based product, ideally in the late summer or early fall. Mow/cut cool season grasses in June to encourage establishment of warm-season grasses, if necessary. (IEC) concerning the above mentioned residential property loc;:1ted at 11 Freezer Road in Barnstable. IEC conducted a site inspection and evaluation of the subject property on 4-2-20 to determine and delineate the boundaries of wetland resource areas located within this property. The day of the inspection was cloudy with light rain. This inspection occurred during the Spring season, at the beginning of the growing season, prior to leaf out conditions. The subject property contains an existing residential house and a garage structure. The subject property contains regulated coastal wetland resource areas, including a coastal wetland, bordering vegetated wetland, coastal bank, land subject to coastal storm flowage, 50' buffer zone, and 100' buffer zone. The subject wetland~ are located within areas of low-lying topography. The subject wetlands continue off property, The coastal wetland and bordering vegetated wetland contain greater than 50% wetland vegetation, hydric soils, pooling areas, and high groundwater conditions. The vegetated wetlands are hydrologically connected to a tidally influenced perennial river (Redezvous Creek), which flows downgradient to the coastal/tidal waters of Barnstable Harbor, and then to Cape Cod Bay. The low-lying coastal wetland contains a significant & dense stand of Phragmites. IEC has delineated the edge of wetlands with the following wetland flags: A-A23. The delineated edge of wetlands is located near the bottom of the coastal bank feature. The top of coastal bank is located directly adjacent to the delineated edge of wetlands, just upgradient from the edge of wetlands, flags A-A23.
