The regularly scheduled Barnstable Licensing Authority Public Meeting was called to order at approximately
9:30a.m. on Monday, September 11, 2023, and was held at Barnstable Town Hall, 2nd Floor Hearing Room, 367
Main Street, Hyannis.
Members Present: David Nunheimer, Chair; John Flores, Vice Chair; Larry Decker, Clerk; Nancy
Karlson-Lidman, Associate.
Members Absent: None
Staff Present: Erin Logan, Interim Deputy Director of Asset Management and Licensing.
Public Comment – There was no public comment made.
NEW BUSINESS
1. Special One Day Beer & Wine License (SPEV-23-139)
An application has been filed by Hyannis Film Festival for a one-day beer & wine license. Sturgis
Charter Public School will be hosting the Hyannis Film Festival’s “Women of Comedy” event at
529 Main Street, Hyannis on October 13, 2023, from 6:00 p.m. to 10:30 p.m. Beer & Wine will
be poured by TIPS certified individuals.
Application represented by Bill Ferrell, managing Director of Hyannis Film Festival. The
individual pouring has changed but the current TIPS certification is on file.
MOTION: Decker moved, seconded by Karlson-Lidman, that the Licensing Authority approve the
application as submitted.

2. Special One Day Beer & Wine and Entertainment License (SPEV-23-142)
An application has been filed by Champ Homes Inc for a one-day beer & wine license and
entertainment license for a comedy show event to benefit Champ Homes. Said event will be
held at Cape Cod Community College, 2240 Iyannough Road, West Barnstable on October 14,
2023, from 6 p.m. to 9:30 p.m. Entertainment to include recorded music and live performing arts
(stand-up comedy); beer & wine will be poured by Joyce Weldon; current TIPS certification is on
file.
Application represented by Adam Burnett, Executive Director of Champ Homes. This is the second
annual comedy show. 1st time at Cape Cod Community College. With no concerns regarding this
application a motion was made to approve the application.

MOTION: Decker moved, seconded by Karlson-Lidman, that the Licensing Authority approve the
application as submitted.

PUBLIC HEARINGS
1. New Annual Common Victualler License
An application was filed by Bagel Mike LLC dba Bagels & Beyond 2, 408 Main Street, Hyannis
for a new annual Common Victualler License. The proposed hours of operation are daily from
7:00 a.m. to 3:00 p.m.
This application was continued to October 16, 2023, at 9:30am.
2. Amend Seasonal All Alcohol
An application was filed by Smith Family Beer Garden LLC dba Smith Family Beer Garden,
541 Main Street, Hyannis for an alteration of premises to increase the seating capacity as
well as utilize in-season and off-season seating plans. The applicant also proposes to amend
the closing time from 11:00 p.m. to 12:00 a.m. daily.
Application represented by Dan Smith, owner of Smith Family Beer Garden with Patrick Smith (other
owner). Smith submitted two plans which would expand their seating indoors. He proposed an in-
season and off-season seating plans. Nunheimer confirmed with Smith that seating in and out would be
weather dependent. Decker confirmed with Logan that the current license is seasonal, expiring January
15, 2024. Karlson-Lidman confirmed with Smith that they have standing room. Decker confirmed with
Smith that he is serving food from their food truck, with food prep done out of their commissary.
Smith noted that the change of hours will fluctuate, and he will likely use the extended time on Fridays
and Saturday nights.
There is a discussion about the entertainment license and timing. Smith confirmed the entertainment
would cease at 10pm. The discussion continued regarding the entertainment and the disruption to the
neighbors. Flores noted that he does not have an issue with the change of hours but is concerned with
the noise and he hopes Smith will monitor the volume.
Mary Myrick, an abutter, expressed concern with the volume of the music and is concerned that
longer hours will mean more noise disturbances.
Nunheimer suggested redirecting the speakers away from the abutters in the rear.
MOTION: Decker moved, seconded by Karlson-Lidman, that the Licensing Authority approve the
application as submitted.

CORRESPONDENCE
Hyannis Inn, 473 Main Street, Hyannis – letter advising the board they are not currently
utilizing the Annual Inn Holder All Alcohol License approved by the Alcoholic Beverages Control
Commission on May 22, 2023.
Nunheimer spoke in favor of approving the temporary closure.
APPROVAL OF MINUTES
MOTION: Decker moved, seconded by Karlson-Lidman, that the Licensing Authority approve
the May 15, 2023 and June 12, 2023.

APPOINTMENT OF ONE ASSOCIATE MEMBER TO REGULAR MEMBER POSITION
Authority members felt it was the responsibility of the Town Council Appointments
Committee to appoint an associate member to a regular member position. Logan will
communicate this to Town Council Appointments Committee and report back.
ANNUAL ELECTION OF OFFICERS
Acting Chair Nunheimer asked for nominations for Chair. Karlson-Lidman moved to nominate
Nunheimer at Chair. So voted aye, unanimous.
Chair Nunheimer asked for a nomination for Vice Chair. Decker moved to nominate Flores as
Vice Chair. So voted aye, unanimous.

MOTION: Decker moved, seconded by Karlson-Lidman, to adjourn the September 11, 2023, Licensing
Authority meeting at 10:18am.
