MINUTES
Wednesday, December 13, 2023, 6:30pm
To all persons deemed interested or affected b y the Town of Barnstable's Old King’s Highway
Historic District Act under Section 9 of Chapter 470, Acts of 1973 as amended. You are
hereby notified that a hearing was held by remote participation via Zoom Meetings on the
following applications:

A quorum being met, Chair Bett McCarthy called the hearing to order at 6:30 pm. The Chair
explained the hearing and appeal process and invited the public to address the Committee and
view the plans of interest when the application is called.

Ryan declared he will be acting in his own capacity and will not be acting in an official capacity
concerning this application.
Ryan Coholan continued the discussion of solar panels. Ryan presented new materials that were
submitted in the form of the letter for the Committee’s review before the meeting. He explained the points
presented in the letter, notably the exemption criteria for solar panels and the precedent that had been set
by the approval of visible solar panels on a property on High Street on a brown roof and visible from the
street which is also a designated scenic street. He understood the Committee wanted to have the
opportunity to drive by the property with the revised plan that was submitted at the previous meeting in
mind. He inquired if the Committee had the chance to do so.
The Committee members acknowledged they had driven by the property.
Wendy- Commented that she had read the letter that was submitted by the Coholan’s and acknowledged
that they were right to point out the High Street property as it is comparable in some respects and in other
respects it is not. She noted that she has no objection to the revised plans. Wendy noted for the record that
she is approving it based on merit and the requirements. She is not approving it because of the insinuation
that something nefarious is going on within the Committee and noted she will not be shamed into a
decision.
Ryan- Explained he was not looking to shame or bully anyone. He wanted to explain the elements of the
exemption and stressed there is no element that lists abutter opposition.
Wendy- Pointed out that it is a public meeting with public comment. Wendy reiterated that she okay with
the revised plan.
George- Accepted the revised plan as appropriate for this particular location. George pointed out each
application is taken and decided upon individually. He agreed with Wendy’s comments.
Lesley- Commented that having solar on the front is the house is like neon and having solar on the side of
the house with trees and set back is more acceptable. Lesley said she wished they were all in the back, but
doesn’t believe they will be visible from the road. The only one that will be affected will be the abutter on
the left side of the house. Lesley believes it will be appropriate.
Bett- Noted she did visit the property three times. The modified layout presented at the last meeting is
appropriate. The panels will not be visible while travelling west and will be barely visible while travelling
east along the road.
Public Comment:
Ann Canedy- Inquired as a point of order since Ryan is on the Committee, why is allowed to speak to this
item and not have to recuse himself?
Kate- Explained that Ryan is allowed to speak to his own item in his own personal capacity but is not
allowed to act in any official capacity regarding the item and must note such before presenting which Mr.
Coholan did.
Nancy Wilson- Inquired about a letter that was sent in from Priscilla Jones earlier this evening and how
the Committee would be treating that letter.
Erica Brown- Commented the letter was sent in shortly before the meeting and had planned to
acknowledge the letter after public comment was made from the attendees at the meeting.
Bett- Asked the letter to be read into record.

Robert DeMelo- Stated the best way to get sun for the solar panels is to run east to west to get the most
efficient way to get productivity. The trees the neighbor planted would grow tall and need to be trimmed.
David Santos- Has had solar at his own home for several years now. He does not know what the buzzing
sound that Ms. Jones is referring to. He has never had this issue. The cost of energy is not going down.
Understands the drive to protect historical roads, but it’s time to delve deeper into new thoughts and ideas
for sustainable energy. Protecting the roof line for aesthetics is silly, but it is up to the Committee and
State the make these decisions.
Steve Carey- Would like to support Ryan for his application. Thinks everyone should be going green to
help the environment.
Priscilla Jones- Main concern is the roof facing her home. Does not want her trees to be cut back. Each
application should be reviewed individually. If it weren’t for her tree line the roof would be plainly visible
from that side. The buzzing sound needs to be taken into consideration. Would like Ryan to use the newer
technology to help prevent this sound. Church Street is historic and she would like to see it preserved.
John Tansey- Only concern is that the approval for the side and back of the home must be exactly
followed to those plans. The plan needs to be confirmed.
Katie Coholan- Does not know how loud the buzzing sound would be, but imagines no matter the decibel
it would not be looked upon favorably. What comes with the panel is what comes with the panel. If the
front panels are denied we may start with the side and come back for the front panels, let it be denied, and
appeal it based upon the precedent.
Ryan Coholan- Commented there is a lot of passion tonight from a lot of people. He commented that no
matter what he does with the property it will not make everyone happy. He asked that the focus be the
elements of the regulation and what has been put forth. There’s passion and interest, but laws are laws and
rules are rules.
George Jessop- One of the things people do not consider is the evolution of solar panels. Part of the
reason that this updated layout of the panels on the west side and rear, the depreciation of the components
which is relatively short. The evolution will allow for a reduction in the amount of solar exposure for the
same level of power. The placement of the transformer to convert the current might be considered in the
exposure of the abutting neighbor. It does not make an excessive amount of noise. The OKH Committee
was formed to protect the existing historic structure not to make modern technology part of the design.

Wendy- Asked Ryan to clarify what design would he like the Committee to vote upon.
Ryan- Based upon Committee discussion, the plan that shows the panels on the front of the roof would be
unacceptable and the plan that shows the panels on the side of the roof and rear would be appropriate. In
essence of comments received from the Committee, he would like to move forward with the second
design.
A motion was made by Wendy Shuck to approve the Certificate of Appropriateness for Coholan, Ryan & Katie, 260 Church
Street, Barnstable, Map 153, Parcel 007, Built 1978 to install 10.935 kw solar panels will not exceed roof panels but will add

Peter Duchesney was in attendance for this item. Matthew Taylor, builder, was also in attendance.
Matthew presented that this application has come before OKH and been approved. The plan is the same as the original, but
they’re adding a dormer to the right side that wasn’t in the original plan. Cedar shingles with woven corners, six over one
windows, and architectural asphalt shingles. The project has taken so long and so they had to reapply for the permit again. The
pictures show the status of the project currently.
Wendy- Just to clarify, this was submitted some time ago and it was approved except for the dormer on the right side?
Matthew- Correct. The plan is identical to what was approved except for the right -side dormer but thinks the dormer looks
more appropriate.
Wendy- The dormer balances the dwelling nicely. You’re shingling, is that correct?
Matthew- Correct. Woven corners on the dormers as well. There’s a bump out on windows to create more depth. Flying rakes.
Two-foot asphalt overhang.
Wendy- Are you putting a chimney in?
Matthew- The chimney is already existing. Brick chimney.
George- Like the way the design has been carried out so far. The projection of the gable end is a nice touch and the overhang
fits the design well. Commented to look into a draft accelerator to get a decent draft. Everything is balanced nicely.
Ryan- Given the location, setbacks, and the work that has already been done, this has added some depth and balance and is
appropriate.
Lesley- Likes the balance. Inquired about the windows.
Matthew- The ones on the new addition match the middle one on the existing part of the home. All trim will match.
Bett- The second dormer balances the home much better. It’s on a very quiet street. Appropriate.

Michael stated he would like to install a front porch on a 34’x7’ bluestone patio.
Ryan- Clarified the addition pitch is 8:12.
George- Asked what the pitch of the original roof. It’s better than 9:12. Asked to clarify if the pitch of the proposed porch is
4:12.
Michael- Correct.
George- Copper roof on the arch top dormers? Is there a reason this is an arch top dormer and not a dog-house style dormer?
Michael- Yes, copper roof. Like the look of it.
Wendy- Isn’t the entryway arched too?
Michael- Yes, the arches will match.
George- Don’t object to the arch top dormers, but it is for a later period of architecture.
Ryan- The roof extension on the porch, are we fixed on the metal roof? Is that the only option? Any other metal roofs in the
neighborhood.
Michael- It is the only option. There is one on Maple Street on a porch very similar to this with a black metal roof.
George- Black metal? Why black?
Michael- Liked the look of it.
George- It’s rather extreme. Not crazy about the all black and white schemes.
Wendy- It will match the black roof though.
George- The pitch of the extension has to be kept low as the dormers are set low on the roof.
Wendy- Do not object to the design. The area doesn’t have any historic homes in the area with a mix of architecture. The
materials are nice and will fit in with the neighborhood.
Lesley- Doesn’t like the dormer windows. It looks like a mishmash of styles. Thinks a dog-style dormers would be more
appropriate for the home. There is eclectic houses within the neighborhood though.

Michael- Likes the look of the design and would like to keep the application as submitted.

Kevin Werner from Fine Line Design was in attendance. Linda DiStefano, homeowner, was also in attendance.
Kevin presented an extension of an existing ranch style home. They will be taking the garage and turning that into a family
room. Where the existing garage doors are, they will construct a open porch with a simple shed roof. All of the materials will
match the existing. New windows will match some of the existing windows.
Ryan- The front elevation probably doesn’t do it justice as it just looks very long. Where the garage is going to be located on the
left, is there any thought to installing a taller window to be more consistent with the rest of the house?
Kevin- Those windows are transom style windows that will match an addition on the back that it will match. The garage doors
have the same type of style so it will wrap around the home. The front will be heavily planted and take up the space and soften
the look.
Ryan- They’re all mounted high and it just doesn’t fit in on the front elevation.
Linda- The reason for the transom windows is more for security purposes because if the double-hungs are there that they will
be set low and it would be easy for someone to break in. Would be amenable to double hung windows, but would like the
porch to be kept transom windows.
George- Agree with Ryan. The existing windows set the tone for the front elevation of the house. Understands why people want
the windows to be higher but that also eliminated the point of them being egress windows. A double hung window is a security
window because of the sash. The transom windows are not appropriate. Would rather see double hungs in each of the bays of
the porch so that you have a balanced design. The door with the double lights is a west-coast cottage door. It is not appropriate
for the east coast.
Linda- Okay with changing to double hung windows. The door that’s there will match the existing to the right.
Lesley- Likes George’s idea and it will break up the long look.
Bett- Agree with George’s suggestion and the windows on the garage whether it is one or two double hung doesn’t particularly
phase her. Are there going to be two new front doors or is it going to mimic the existing door.
Kevin- Mimic the existing door.
Bett- Matching it would be desirable. This area is very remote as well. A lot of trees and shrubbery.
Wendy- Agree with the rest of the Committee. Looking at it everything looked so horizontal that it needed a vertical element.
Trust George as the architect that the change in windows will be a great improvement.

Kevin Werner from Fine Line Design was in attendance. Homeowner John Spinney was also in attendance.
Kevin presented an overview of the project. It is a cottage community. A renovation is being proposed including taking the
asphalt roof and making it a cedar roof, bleaching wall cedar shingles for siding, 9 over 6 windows will be replaced with
traditional 6 over 6 windows with wood or composite shutters and use the traditional hardware. The deck will be rebuilt. The
windows on the gable ends will be boxed out with a copper accent pediment. The gutter will be copper with copper
downspouts. The chimney will be removed and replaced with a faux chimney with fieldstone and copper accent cap. A small 3 x
5 shed on the rear.
George- Asked about the skylights added.
Kevin- Yes, the ceiling is already vaulted, and the homeowner would like more sunlight.
George- Will the copper be bright copper or will they be allowed to weather?
John- Let them weather if the HOA will allow the copper gutters. May have to come back with a different material to be more
traditional look/material. Flexible to the HOA and the OKH stipulations.
George- Something boxed in on the left hand side, is that an outdoor shower?
John- Yes, plan to move the shower from the rear to the side of the cottage and it will be the same size of what is existing.
George- Appropriate.
Wendy- Thinks this is a very nice renovation and will fit in with the other cottages. No objections.
Lesley- It will all be shingled?
John- Yes, they will be shingled with bleached oil. So it’s a silvery look?
Kevin- It will be a grey/silver color.
Ryan- Comments are minimal; great replacement for the structure.
Bett- It’s an adorable little community of a cottage colony and this will design will fit in nicely. No issues.
Public Comment:
Ann Canedy- It is a cottage colony. The cottage colony was designed to represent a small village and each cottage represents a
town hall, a village store, a captains house, etc. This one is the ye olde adam’s house. It is a beautiful renovation, but it does not
represent the historical aspect. The chimney and copper pediments are not appropriate. Will the shower enclosure be painted
white or will it be a natural wood enclosure?
John- Cedar enclosure. Grey. The cedar shingles will also weather into grey.
Amy Collins- Representative from the HOA is in attendance. John’s been forthcoming with his plans. The HOA does have
concerns and John is aware. The HOA cannot support the renovation as it stands right now. Some of the concerns, Ann
mentioned. The materials used from the copper are not common to the village as a whole. The size was also noticed on the
chimney and do their best to keep everything as similar as possible. The biggest concern is that the character of the home
remains and fits in with the community as well as the materials that are stipulated within the bylaws of the association.
Lesley- Amy just layed out that this is inappropriate for that area.
Bett- It is not the responsibility of the Committee to meet the criteria of the HOA, but rather if this cottage renovation is
appropriate within the Old King’s Highway Historic District. It will be up to the homeowner to hammer out the details with th e
association and come back to OKH with any minor modifications for materials, color, etc.
John- Is working with the association. Will do their best to adhere to the bylaws and will sort out the few homeowner’s points
and once we get to the right answer, we will come back if we have any minor modifications.
Amy Collins- Separate from the bylaws, still believes the use of the copper material is inappropriate for the historic district as it
does not fit in with the time period of the home.

Jim Hagerty from Reef Builders was in attendance as well as homeowner Stephen Constantino.
Jim presented an undeveloped piece of land that abuts the owner’s home in the rear. They are proposing a carriage house on
the land. It is a different address and as such is why it is not just a garage. The design is a carriage house that carries o ver the
design from the home. It has the exposed rafter tails, the copper accents over the garage entry and attachments, and all
elevations of the carriage house are visible from the street. Board and batton detail on the smaller sections. Tried to keep the
structure small so that it is not a giant structure. The main girth of the building is thin and added the square footage by a dding
the projections to the front and the back. Natural shingles, asphalt shingles on the main roof, brackets on the front of the
carriage house doors. Will be true carriage house doors that swing open. 26’ high.
George- What are the windows that will be used? What are the rafter tails?
Jim- Double hung Anderson windows and the grilles to match the main house. The rafter tails will match the main house and
azek will be used.
Ryan- Appropriate.
Wendy- Appropriate. Likes the fact that it isn’t too big and it fits in with the neighborhood very well.
Lesley- The main house is a large house. Whats the square footage of the carriage house?
Jim- 900 sq ft.
Bett- Design fits in very well. Very nicely done. Appropriate.

Peter McDonald was in attendance as well as homeowner Micharl Girardi.
This neighborhood has many different styles of homes throughout it and this house appears to have been added on throughout
the years. They are planning a 16 x 12 addition to the garage. The side door is the only door that gets used and would be
turning that into the front door. Several additions to the rear of the home that will not be visible. New siding, roof, windo ws,
and trim. Materials will be cedar shingles and some white clapboard to continue the mixed materials. Asphalt shingle roof tha t
will be dark grey and grey trim.
Ryan- Area is fairly off the beaten path. No two of the homes are the same in the neighborhood. Appropriate,
Lesley- Appropriate. Like the door and arch which breaks up the long portion of the house.
Peter- No length is being added to the home.
Wendy- An improvement. Are you taking out the existing front door?
Peter- Yes.
Wendy- Like the entry way and the way that is peaked. Materials are appropriate. Eclectic neighborhood. No objections.
George- This house has enough breaks in the ridge for it to be acceptable. Moving the entrance is a modern trick. Is there
enough doors on the other end?
Peter- There are three doors on the back of the home.
Bett- Appropriate.
Wendy- Asked about the deck.
Peter- There’s a little deck in front of the new door and one on the back of the house. Deck on the rear would be moved to the
right. Flat no railings.
