Box 485 West Harwich, MA 02671 Re: 15 Hinckley Road / Pain Dā€™ Avignon ā€“ Pizza Oven Dear Mr. Ford, It was a pleasure speaking with you today regarding the subject property. I am in receipt of your correspondence dated January 26, 2024, in which you request on behalf of your clients to u?lize a pizza oven located in the area under construc?on. In your leer you opine that th e oven as a stand-alone device is incidental to an exis?ng restaurant use on the premises and that your client should be allowed to use the oven so long as there is no aempt to allow the public into the new area un?l t hey are finished with proper permiAng. I concur. The use of the oven is considered customarily incidental to the exis?ng restaurant use and so long as the space is not occupied or u?lized by the public without a cer?ficate of occupancy then there would be no building code or zoning viola?on. This response should be considered my approval of the use of the oven con?ngent upon comple?on of the following: 1. All plumbing & gas permits have been obtained, inspected, and closed out. 2. All Electrical permits have been obtained, inspected, and closed out. 3. The architect, under construc?on control, requests a condi?onal Temporary Cer?ficate of Occupancy (TCO). a. Condi?oned that only cooking staff u?lize the space un?l a permanent Cer?ficate of Occupancy has been issued and that no member of the public is permied to enter the premises under the TCO. I trust that these terms are acceptable and that the architect will be able to make his request at some point this week. If you have any ques?ons, please do not hesitate to contact me.
