The Request for Determination of Applicability is typically used for minor projects. Advance consultation with Conservation Division staff is encouraged. B. Complete the Request for Determination of Applicability application (WPA Form 1) https://www.mass.gov/doc/wpa-form-l-request-for-determination-of-applicability/download and attach the following to it: l. A signed "Permission to Access Property-Form PA". The form must be signed by the property owner, or legal representative, and submitted prior to the RDA application being docketed and application advertised. Fom1 PA is available at www.townofbarnstable.us/Conservation . Do not send abutter letters out until Form PA is signed and submitted to the Conservation Division office. 2. Your sketch of the project on an existing engineering plan or GIS plan. The sketch or plan shall be drawn to approximate scale and shall depict both the project footprint and the offset distances to a wetland resource area (i.e. wetlands, coastal banks, dunes, etc.) The sketch shall also be signed and dated by the preparer. GIS plan may be obtained in Conservation. 3. A copy of the U.S.G.S. locus map may be obtained from Conservation. Indicate project site with an arrow and write the word LOCUS. 4. A list of direct abutters and Assessors map of their location. These are available on the town web site at town.barnstable.ma.us or you may request assistance from Conservation staff. Under Chapter 237, Wetlands Protection, of the General Ordinances of the Code of the Town of Barnstable, property owners actually touching on the subject parcel upon which work is proposed shall be notified. 5. A copy of the abutter notification letter. Complete the letter supplied to you. The staff will issue you a date and time the public hearing will be held when the application is ready to be submitted. The notification letter should be sent by certified mail, the same day the application is submitted. Please plan on attending hearing. 6. Written detailed directions to the project site. C. Make 10 copies of the application with items #1-5 attached. Submit the original plus 8 copies to the Conservation office along with the filing fee. The site is located in the HH Hyannis Harbor District of the Growth Incentive Zone in the Hyannis Downtown area. The sites consist of a 0.75 acre and 0.57 acre lot respectively. The lots are on either side of the South end of School Street, which is paved public roadway which ends just South of the properties at the Steamship Authority terminal building and a private marina. The only work within conservation jurisdiction for this RDA is the Southeast corner of #115 School Street Street where a transformer and underground manhole and landscaping will be constructed within the outer area of a 100' buffer to the coastal bank across School Street from locus. The Western abutter is the Woods Hole, Marth as Vineyard , Nantucket Steamship Authority parking lot, and the Easterly abutter is a residential property on South Street. Southerly abutters are the Steamship Authority and Dockside Marina LLC, and the sites are bordered on the North by the public way of South Street. A parking lot and a residence are across South Street from locus. The sites are both located on high ground, approximately twenty five feet above sea level, and enjoy a view of the Hyannis Inner Harbor, and out to Lewis Bay. It is proposed to construct underground parking beneath both buildings, #115 School Street will have 26 dwelling units and a total of 32 parking spaces, and #110 School Street will have 28 dwelling units and 39 parking spaces. The buildings are connected to town sewer and municipal water and are served by natural gas. Both buildings will be fully protected by fire sprinklers. The streetscape will be improved by removing the poles and overhead wires and running the electric lines underground from South Street to the end of School Street, with a new at grade transformers replacing the current overhead transformers. New low level lighting is proposed on both sides of School Street. All stormwater from the impervious surfaces on the site be collected and directed to extensive subsurface stormwater infiltration systems. The attached stormwater report and drainage calculations indicate full compliance with the State DEP Stormwater Management guidelines, and the Town of Barnstable requirements for commercial properties that all stormwater be infiltrated onsite. The work for the site is partially within the buffer zone to a Coastal Bank. The landform containing the Coastal Bank is a large slope down towards the Harbor on the South side of #110 School Street. The Coastal Bank transects were surveyed by Down Cape Engineering, Inc. The Hyannis Inner Harbor is mapped as an AE el. 12 FEMA flood zone near locus, and this elevation contacts the existing slope about six feet above the paved parking area for the Dockside Marina. The runup slope of approximately 47% has a distinct break to near level at elevation 16, where a wide shelf exists that defines the top of both the state and local definition coastal banks. The delineation is the same as SE3-3958, which permitted a building for the Dockside Marina adjacent the bank. The Order of Conditions for this project has been extended and is still current. The roof of the Marina building is restricted low in height to below elevation 28.9 NAVD88 in order to provide a view easement for the proposed multifamily structures, so the two projects are compatible in that respect. Silt fence work limit lines will protect the bank and adjacent properties during construction. A stormwater report with construction period pollution prevention plan measures will be enacted for the project, see the Stormwater Report for details. -1 - The 50' buffer on locus will be nearly completely revegetated, and all structures and hardscape removed from within the buffer, see the planting and landscape plans for details.
