I normally do not provide a rationale for the proceedings to an appeal of my decision but I think the Board would benefit from these comments: We have requested financial information in accordance with MGL 40A sect. 3 (agricultural exemptions) and a site plan for site plan review. As the continuance is dependent on other professionals (accountant/surveyor) I understand that it may take some time… therefore please advise the Board that our enforcement order is under a stay. I would like to ask for a continuance, but for a different reason. The Building Commissioner and I have been in communication with each other, and it seems that we may be able to resolve this matter by agreement. This would result in a withdrawal of the appeal. 2 But, in order to resolve the matter, my clients need to provide certain information to the Building Commissioner. This is going to take some time. Accordingly, I would like to ask for a continuance of 2 months if possible. Brian Florence and I discussed this, and he is in agreement with the request for continuance. I will, of course, sign a waiver of the time requirements. Is this possible? Is this email sufficient to set forth the request, or do you need a letter from me? Also, do I need to appear tomorrow night? Or is an agreed-upon request for continuance something that the Board would grant without requiring an appearance?
