Dear Mr.McKinney: At a recent public safety Inspection of your premises known as the Harbor View Club in Cotuit several areas of concern were noted.The inspection was made with Thomas J.Carr,State Building Inspector and John Newton,Inspector of Wires and Deputy Fire Chief.The areas of concern which must be corrected are as listed: 1.The key lock on the dining room exit door must be removed and replaced with a panic device. 2.The clothes chute must be fire stopped at the floor level and completely sealed with fire code shcetrock. 3.An exit from the second floor rear stairs must be created to grade level and the service entrance to the basement must be partitioned and closed. 4.An exit must be created from the third floor through room #15 with stairs leading to grade level. 5.Your sleeping area Is directly above the stairwell wilch presents a safety problem.Should a fire occur in the building the stairwell would serve as a chimney filling the upper levels with smoke,which could be disastrous. I am sware of the beautiful stairway which is present,how ever,the area of safety is essential.Therefore,I am requiring that a smoke encloser on the second and third floors be installed and would recommend a wire glass encloser. In the Order After Rescript issued in the case of Allan F. Crawford v.Building Inspector of Bamstable et al,Harborview was "...forbidden the use of the pier for the mooring of boats or as a means of access or egress from the intervener's premises and the respondent Building Inspector is ordered herewith to enforce the aforesaid Order." There is no question in my mind that this Order clearly prohibits the use of the floats above mentioned to accomplish the same purpose and on behalf of our clients,request is hereby made upon you that you keep the situation under surveillance and if any endeavor is made by Harborview to insert the floats into the water,immediate steps be taken by you to prevent such action. The only non-conforming use protection that Harbor view has is at a hotel,and to my knowledge no special permit to change the non-conforming use from a hotel to a yacht club has ever been granted by the Board of Appeals. If,in fact,Harborview is operating now as a yacht club,it is my opinion that such present use is an unlawful change of a non-conforming use and is,therefore,illegal under a zoning by-law. Mr.Anderson makes an assumption that we wish to clear up We are not preparing to replace our dock, or pier for the purpose of mooring boats. At present our members'boats are contained on owners moorings properly placed and constructed in accord ance with instructions from the Harbor Master.In addition,our members are using the excellent and permanent facilities at the town dock to moor their dinghys.Also,our members are beaching their dinghys and small sail boats on club property as has always been our custom. We note the Supreme Court ruling acknowledges this customary usage and normal egress to our property by quoting before the pier was built,people moored their boats in the bay and came to the beach by dinghy!,others would beach directly in front of the Inn .Mr.Anderson quotes a portion of the ruling which states specifically that boats cannot be moored at the now removed and non-existant permanent pier, and that any limitation as to egress or usage specifi cally relates to the aforementioned pier. We are going to seek permission from the Harbor Master to anchor off shore our swimming float.This is a normal accourterment to beach front usage under the direct authority of individual harbor masters.It is not our intention to moor this float to allow ac cess to land.We have constructed some small service floats to be used at the discretion of the Harbor Master,at selected moorings now used in the Harbor, COTUIT,CAPE COD.M ASS A C M U S ET T S OS636 -2- not accessible to land. We do intend to seek,thru the proper channels^the permission to moor a string of dinghy floats (non- permanent)and these will not be installed until proper clearance is obtained.Attorney Bernard R. Dwarks's letter to Robert O'Neil showing our first step in obtaining clearance has been sent under sep arate cover. It is presumptuous for anyone to assume that this would be forbidden by previous ruling^since we are contemplating use of a temporary float for the more convenient landing of dinghys^a usage already estab lished.
