The existing property contains a single-family home and is bordered by single-family homes to the south and east with Lake Wequaquet to the north and west. The applicant would like to install a 6’ tall stockade fence along the eastern property line to provide privacy from the neighbors at 129 Hayes Rd. The resource areas that are located within the work area are the 100’ buffer zone to bordering vegetated wetlands and the 100’ buffer zone to land under water (Lake Wequaquet). The last 50’ of the fence closest to Lake Wequaquet will be elevated 18” above the ground to provide passage beneath of wildlife. The applicant is also proposing to plant four native cedar trees along the proposed fence line. The Massachusetts Wetlands Protection Act lists exempt minor activities located within the buffer zone. 310 CMR 10.02(1)(b)(2)(b) lists "Fencing, provided it will not constitute a barrier to wildlife movement…" The proposed project involves the installation of a fence that will not constitute a barrier to wildlife as portions of the fence will be elevated 18” to allow for wildlife movement. This application Is being submitted in accordance with the regulations stated within the Massachusetts Wetlands Protection Act (310 CMR 10.00) and the Town of Barnstable Wetlands Protection Bylaw.
