Notice of Intent George and Laurie Attar,306 Long Beach Road,Centerville,MA Performance Standards Narrative and Construction Protocol Site Description The property is located on the south side of the Centerville River,approximately one mile from the outlet to Nantucket Sound.The building is a 4-unit condominium,and the existing dock is shared by the owners.The waterway outlet is also classified as the mouth of a coastal river.The site has a grassed back yard that is fairly flat to the edge of the lawn.Seaward of the lawn,there is a sloping rock revetment along the waterfront,and then salt marsh and beach flats.There is an existing 4’x16’pier,with a 3’x14’ramp,a 8’x16’float,and a 8°x19"float. The salt marsh is healthy,and the beach front is covered with green seaweed and such.The bottom is fairly soft. MLW extends approximately 31 feet to low tide.Currently,the landward edge of the floats rest on the bottom during low tide.The bowof the boat also rests on the bottom at extreme lowtides.The river width at this location is approximately 209 feet from MLW to MLW.The existing configuration is both permitted and licensed,with the order receiving a certificate of compliance in 2013.There are two boats used at this dock:a 28-foot Boston Whaler Outrage,with a 9°-4™beam,and a draft of 22 inches (online specs).The other boat docked at this site is a 17°Edgewater (16’-10”long),with a 7°-3”beam,drawing approximately 12 inches (boat only,online specs). Project Description The purpose of this project is to reconstruct the existing dock and extend it 13 feet,for a total of 29 feet long.The existing 3'x14"ramp will be reconstructed and used.The floats will be shortened to two (2)8°x16”floats.The dock is proposed to be raised up three (3)feet to allow 5 feet of clearance to the underlying support member for sufficient clearance over the marsh and where public access is allowed under the dock without access steps.There is also a S-foot ramp proposed to access the higher dock from the lawn.The longer dock and the shorter floats will extend the existing end of the floats out 9 feet further from existing.The area landward of the dock is low and retains water during storms.The applicant would like to loam and seed this area to level it with the rest of the yard in that area.No change in runoff is proposed:just to reduce puddling.There is no work proposed on the rip- rap revetment.No dredging is proposed. Dock Extension Calculations (704-J) J (1);The lot frontage is 120°.Therefore,according to paragraph J (1),a dock can’t extend more than 2 of the frontage,or 60 feet from a line across the waterfront lot corners.The east lot line extends further than the west property line.A line drawn between these two and then offset 60 feet reaches 19.5 feet farther than the dock extension is proposed.Therefore,the proposed dock extension conforms to this requirement. (J)2;It is unclear as to where the channel extends in this river.There is 90 feet of clearance between the existing float now,and the other existing float across the river.The 9 foot extension will reduce this width to 81 feet.And the boat is docked “bow in”,so there is no additional extension due to the beam of the boats.The 9-foot extension yields the stern motors at the end of the float,quite similar to the adjacent docks if they had a boat beam of similar size docked at their floats.Therefore,the proposed float and boats will not extend further into the channel (wherever it is)than the adjacent float and boats. (J)3;The river width at MLW is 209 feet.The license plan (License No.5198,issued in 1996,states a waterways distance from the existing floats to be 180 feet to MLW on the opposite shore.From that point,the existing dock extends another 29 feet to MLW on the applicant’s property.Therefore,the total river width is 209 feet.20%of that length is 42 feet from MLW.The proposed dock will extend 42 feet from MLW,conforming to this requirement. Navigation The river has many docks along the waterway.The existing dock and floats extend into the water nearly the same as the adjacent docks on both sides.However,those float are perpendicular to the shoreline,so any boat docked at that site adds to the extension into the waterway for that location.This is true of both docks on either side of the applicant's property.The applicant is proposing to keep the existing float arrangement,but extend the float out 9 more feet to gain more clearance under the larger boat,and so that the boats bow and the floats are not grounded in lower tides. Page 1 of 8 Notice of Intent George and Laurie Attar,306 Long Beach Road,Centerville,MA This will put the stern (and the motors)of both boats in deeper water without extending into the riverway more than surrounding docks and floats with boats.The floats are also shortened to provide 1 foot of clearance at MLW to correct the existing grounding condition.The extension is in conformance to the guidelines for dock extensions into a waterway.Therefore,no impacts to the surrounding waterway in regards to navigation are anticipated. Conformance to the Town of Barnstable dock guidelines. A shellfish survey was performed in March of 2024,and indicated shellfish located in a line near the MLW line on the west side of the waterfront,and along a line about 13 feet seaward of the MLW line on the north side. Refer to the shellfish survey letter,tabulated results,and tabulated plan for the survey enclosed with this filing. Town of Barnstable Saltwater Dock Guidelines The guidelines for private salt water docks and how this project conforms to each guideline are listed below: A)The dock is an accessory structure to an existing dwelling. B)The dwelling is legally occupied. C)The proposed dock is made of wood;either pre-fabricated or fabricated and assembled in place with either cedar or grated decking.Non CCA materials can be used,except for the support piles. D)There is no lighting proposed for the dock,but if so,would conform to the requirements. E)Public access along the shoreline is provided under the dock at MHW,as allowed by Chapter 91,by allowing the required 5 feet of clearance to the underlying structural member at MHW. F)The permit number will be displayed when the dock and floats are reconstructed. G)The dock’s floats are not stored in the back yard or in the resource area;they would be stored either in the driveway or an off site storage area. H)The (2)8°x16 floats occupy 256 square feet,whereas the regulations have a 200 square foot maximum. The proposed float square footage equals the originally permitted (2)8'x16”floats,and is therefore previously approved and carried forward for this permit.The floats were shortened and extended to maintain the required 12 inches of clearance at MLW. I)The project plan requires 2"x6”decking with %”plank spacing.The dock crosses 13 feet of salt marsh, and grating can be used in this location is desired. J)See paragraph for this item,above.The dock meets all of the extension requirements under this paragraph. K)The dock extends to a practical length for the shared use boats at this dock,and does not obstruct the use of the waterway. L)The existing dock is located approximately 22 feet east of the centerline of the lot.The dock was permitted and licensed in this configuration,and it only makes sense to keep it in the current location. The dock does extend nearly perpendicular to the shoreline,and does not obstruct the waterway. M)The shellfish values along this shoreline appear to be rated 6 or above (high value).Therefore,30 inches of water is required under the boat at MLW.Since the maximum draft for the boats is 22 inches, (according to manufacturer specifications),and the depth at MLW at the end of the proposed floats will be 5.8°,the design conforms to this requirement. N)The area is not within an ACEC. 0)The dock does not interfere with any public use of the waterway as it does not extend into the waterway further than surrounding docks with boats docked at them.No matter what size boats are at this dock, they will not extend further than the extension because of the float orientation. P)In the opinion of Shorefront Consulting,the proposed extension is not considered to be “substantial”. The overall length increase is proposed to be 9 feet out of an existing total length of 62 feet;about (14 percent).The term “substantial”appears to be subject to interpretation,as there doesn’t seem to be a definition of substantial in the regulations.The proposed extension provides a benefit to the surround resource areas. Q)There is no boat lift proposed for this site. R)There is no dredging proposed for the site. Option 1: Do nothing. If nothing is done at this site,the float will continue to ground out at MLW.The bow of the boat also grounds out at lower tides.This is not desirable for the environment or the boat.The dock is showing signs of age,and could be upgraded to current standards.Further,the existing dock is only about 2.5 feet above the marsh.Raising the dock reduces shading impacts,so leaving the dock “as is”is not desirable for several reasons.Proper public access under or around the dock is not currently provided.The license plan shows the floats grounded at MLW,and shows public access around the upland end of the pier.While allowed,strolling pedestrians would have to climb up the rock revetment and around the dock and back down.Therefore this option was not chosen. The dock was permitted and licensed around 1994 in its current location.This is approximately 22 feet east of the centerline of the property.The clearance to adjacent floats is approximately 95 feet to the west,and 65 feet to the east.While centering the dock would leave the clearances at 73 feet and 87 feet,respectively,this is nearly a reversal of clearances to the adjacent floats,and doesn’t provide any real gain in the location of the dock.There is plenty of room for navigation where the dock is located now.The lawn area is configured for this location,and relocating the dock would cause more disturbance in a different location.Therefore this option was not chosen. Option 3: Do not loam and seed the area landward of the dock. This area is lower than the remaining back yard,and retains water.The applicant wants to use loam and seed to level this area.While this is a preferential request,the practical application reduces standing water on the site, which could reduce mosquito populations.Therefore,the applicant wants to level the area,and not leveling the area is not the desired option and is therefore not chosen. Option 4: Extend the dock,but keep the dock at it’s current height. If the dock is kept at it’s current height,there is less clearance over the marsh.It was suggested to raise the dock to reduce shading impacts,and bring the dock up to current standards.If this option was chosen,it could potentially negatively impact the marsh,so therefore this option wasn’t chosen. Option 5: Project as Proposed, The project as proposed reduces existing negative impacts from the dock and the floats,and reconstructs the dock to meet current standards.The dock will be elevated to provide clearance over the marsh,and proper public access under the dock.The floats will be positioned to avoid grounding.The boats will have more available draft,and do not affect navigation at the site.Potential impacts from ponding will be eliminated. Therefore,for all the benefits for the desired proposal,this option was chosen. Performance Standards The work associated with this application is limited to the reconstruction of a permitted and licensed dock system. The existing dock and proposed extension is located in or near several resource areas.The areas potentially affected by the project include Riverfront Area,Land Subject To Coastal Storm Flowage,Coastal Bank,Salt Marsh,Coastal Beach,Land Under Ocean,and Land Containing Shellfish.Each area is addressed below. Riverfront Area —The area of work within the riverfront area is limited to the installation of the 5°ramp and the loaming and seeding.There is both 100-foot and 200-foot riverfront area buffer zones on this property.Most of the property is within the 0-100 riverfront area.The proposed work is limited to approximately 541 square feet of loaming and seeding and the 4°wide by 5°long ramp.The area is established lawn.None of this work will negatively impact the riverfront area itself.Flooding will be less,and drainage will be improved.Please refer to the discussion of project alternatives stated previously in this narrative. 310 CMR 10.58 (3);“Where a proposed activity involves work within the riverfront area,the issuing authority shall presume that the area is significant to protect the private or public water supply;to protect the groundwater;to provide flood control;to prevent storm damage;to prevent pollution;to protect land containing shellfish;to protect wildlife habitat;and to protect fisheries.” The riverfront area,being so close to a salt water river,likely does not provide protection for private or public water supplies or groundwater.In these areas,there is likely an amount of salt water intrusion into the groundwater at some distance from the river's edge,and at lower elevations.The other functions of the riverfront area,such as flood control,storm damage prevention,and the prevention of pollution,the protection of land containing shellfish,and wildlife habitat remain unchanged.Therefore,it appears that two of the interests may not be applicable for this property. Page 5 of 8 Notice of Intent George and Laurie Attar,306 Long Beach Road,Centerville,MA “By providing recharge and retaining natural flood storage,as well as by slowing surface water runoff, riverfront areas can mitigate flooding and damage from storms.The root systems of riverfront vegetation keep soil porous,increasing infiltration capacity.Vegetation also removes excess water through evaporation and transpiration.This removal of water from the soil allows for more infiltration when flooding occurs.Increases in storage offloodwaters can decrease peak discharges and reduce storm damage.Vegetated riverfronts also dissipate the energy of storm flows,reducing damage to public and private property.”This is the primary function of the riverfront area for this property. “Where the presumption set forth in 310 CMR 10.58(3)is not overcome,the applicant shall prove by a preponderance of the evidence thal there are no practicable and substantially equivalent economic alternatives to the proposed project with less adverse effects on the interests identified in M.G.L.¢.131 §40 and that the work,including proposed mitigation,will have no significant adverse impact on the riverfront area to protect the interests identified in MG.L.¢.131 §40." According to the above,the riverfront area may not play a role in in the protection of fisheries,groundwater or private or public water supplies.This equates to the “one or more”ofthe interests in 310CMR 10.58(3). Therefore it appears that the presumption is rebuttable,and the presumption of significance is partially overcome.However,there are no practicable and substantially equivalent economic alternatives (see alternatives,above)to the proposed project with less adverse effects.Even the “do nothing”option has adverse effects to the riverfront area interests.The proposed work will have no significant adverse impact on the riverfront area to protect the interests identified in M.G.L.¢.131 §40. Land Subject to Coastal Storm Flowage (LSCSF)—LSCSF is considered a resource area under 310 CMR 10, section 10.02 (1)d.The work proposed in this area is limited to the installation of the access ramp for the newly elevated dock,and the loaming and seeding of the approach area to reduce ponding.Any areas disturbed during implementation of the project will be returned to their pre-construction condition.No significant negative impacts to this interest are proposed either in the interim or during the construction effort. Coastal Bank -The area of work over the coastal bank extends from LSCSF 4 feet seaward to the coastal beach. The dock crosses this area.There is an existing stone revetment along the entire shoreline,which will not be disturbed.The dock starting end is cantilevered over the bank so that no piles are in the revetment or the bank. The project merely spans the bank,without disturbing it.The bank is considered to be a buffer against storm damage,and because of the existing permitted revetment is not considered to be a sediment source for any downdrift beach.The project will be conditioned to prevent negative impacts to the bank.No negative impacts are anticipated.Therefore,the project as proposed can be permitted under 310 CMR 10.30 (6)through (8). Salt Marsh —The area of salt marsh extends about 13 feet under the dock,from the base of the revetment out to the beach.There is one set of piles currently within the salt marsh,with an additional set proposed in an eleven foot span (4 total).The dock height will be increased by 3 feet to reduce any shading impacts.The piles are permanent,allowing a one-time disturbance.The marsh area can actually be pierced in the center of the pile location,with the penetration expanded so that the pile will go through peat,and not actual salt marsh.Therefore, while the plants will be compressed around each pile,there will be no loss of salt marsh as a result of the pile installation.The existing dock is elevated to have 5 feet of clearance under the lowest structural member at MHW; reducing shading impacts.Lateral public access is provided both around the start of the pier and under it,which is allowed under Chapter 91.The project as proposed minimizes the potential for negative impacts to this resource area.There are no significant negative impacts anticipated,meeting the performance standards for this resource. Therefore,the project can be permitted under 310 CMR 10.32 (5). Coastal Beach —The area of coastal beach extends approximately 13 feet at the edge of the salt marsh to MLW.There is one set (2 total)piles in this area.The proposed pier construction is designed in accordance with,and exceeds all regulatory guidelines and therefore will not change the role for the beach in storm damage prevention,flood control,or protection of wildlife habitat.The boat and floats will no longer ground at lowtides. Page 6 of 8 Notice of Intent George and Laurie Attar,306 Long Beach Road,Centerville,MA The pier will also not change the volume or form of the beach sediments,the ability of the beach to respond to wave action,or the effect for any downdrift beach.The pier,as designed will have no adverse impacts to the coastal beach,and therefore meets the performance standards for work on a Coastal Beach.Therefore, the project as proposed can be permitted under 310 CMR 10.27 (1)through (7). Land Under the Ocean —Approximately 286 square feet of the proposed pier,along with the ramp and floats and four anchor piles are located in this area.The construction protocol prohibits bottoming of the working barge to avoid negative impacts to the bottom substrate.Projects not included in 310 CMR 10.25(3)which affect land under the ocean shall if water-dependent,be designed and constructed,using best available measures,so as to minimize adverse effects,and if non-water-dependent,have no adverse effects,on marine fisheries habitat or wildlife habitat caused by alterations in water circulation,destruction of eelgrass (Zostera marina)or widgeon grass (Rupia maritina)beds,distribution of grain size,changes in water quality, including,but not limited to,other than natural fluctuations in the level of dissolved oxygen,temperature or turbidity,or the addition of pollutants;or alterations of shallow submerged lands with high densities of polychaetes,mollusks or macrophytic algae.The project,as proposed,has no adverse effects,and the large pile span reduces the number of piles needed to support the pier.Therefore,the project can be conducted and permitted to minimize adverse effects to the listed interests in accordance with 310 CMR 10.25 (6). Land Containing Shellfish —As previously stated,the area that may have shellfish present accounts for approximately 286°of the pier,ramp,and floats.The piles will be installed in accordance with the construction protocol,and any Time of Year restrictions.If necessary,any existing shellfish can be relocated to the sides of the project before construction to maintain the habitat. The project as proposed does not have any impacts to this resource,and will have no negative effects on the following interests: (a)alterations of water circulation; (b)alterations in relief elevation; (c)the compacting of sediment by vehicular traffic; (d)alterations in the distribution of sediment grain size; (e)alterations in natural drainage from adjacent land;or (f)changes in water quality,including,but not limited to,other than natural fluctuations in the levels of salinity,dissolved oxygen,nutrients,temperature or turbidity,or the addition of pollutants. By following these proper design and construction protocols,the project can be permitted as proposed without negative impacts to the shellfish resource and in accordance with 310 CMR 1034 (4). The work area shall be kept to a minimum.All equipment shall be stored on the applicant’s property or on a working barge when not in use.A silt curtain shall be used during any silt producing activity.The working barge shall be prohibited from grounding at any time,and must be stored in sufficient water depths at all times. Pile Driving protocol: All pile driving shall be performed outside of any time of year (TOY)restrictions.If the piles are installed from a working barge,the barge shall not be positioned so as to bottom out at any time.Piles shall be mechanically driven and not jetted. Pre-Construction Meeting Prior to construction,a pre-construction meeting shall be held on-site with the Contractor,Property Owner, and the Conservation Commission and/or agent.The purpose of the meeting is to clearly delineate the limits of work and access,as well as the staging area.The Contractor will describe the proposed means and methods for performing the work within the requirements of the plans,order of conditions and construction protocol. The Contractor will comply with mitigation measures as established by the Conservation Commission. To be discussed at this meeting: Existing property conditions,necessary precautions to be taken by the Contractor; Means and methods for construction; Necessary post-construction reparations and conditions; Procedure for post-construction inspection; Shorefront Consulting’s responsibilities for inspection and project coordination During Construction,the site shall be accessible for inspection during reasonable hours by all parties, members of the conservation commission and their agents,and the Project Manager. Post-construction meeting Upon completion of construction,but prior to equipment being removed from the site,a post-construction meeting shall be held on-site with the Contractor,Property Owner,and Conservation Commission and/or agent.The purpose of this meeting is to determine that the project has been satisfactorily completed in accordance with all permits,and that no additional work or mitigation is required by the Contractor. Restoration of project area Upon completion of construction,the driveway,beach,marsh,staging areas and any other areas disturbed by the construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of the property owner and conservation agent.All disturbed vegetated areas shall be re-vegetated with matching vegetation to match pre-construction conditions for the surrounding areas,or as determined during the pre-construction meeting.
