Notice of Intent Gerald Kashuk,Trustee;188 Bay Shore Road,Hyannis,MA Performance Standards Narrative and Construction Protocol Site Description The property is located on the north side of a peninsula on the north west side of Lewis Bay,a tidal inlet on the south shore of Hyannis/Barnstable.The larger portion of Lewis Bay is located south of the peninsula,leading approximately 1 mile to Kamus Park Beach and the opening to Nantucket Sound.The site has an existing permitted and licensed dock.The entire property is within the flood zone,with the elevation of the back yard between elevation 4°and 7°,with the flood elevation at 11°.The back yard is mostly lawn,with an extensive vegetated buffer strip approximately 7 feet wide on the south side of the lawn,and gradually increasing to approximately 32 feet wide by the northern property line.The buffer is made up of mostly woody shrubs,and is densely planted.Moving seaward,there is combination of several attempts at shorefront protection including rip- rap rocks,sand bags,telephone poles and such that extend approximately 77 feet across the waterfront.The sandy beach had a new eroded scarp at the time the photos were taken.The water's edge gets closer to the revetment the further north you go,but does not touch the revetment.None of the protection is organized,and the protection is shifting and deteriorating because it is not installed properly.It does not appear that the shorefront protection was ever properly permitted,and the origin and date are unknown.The dwelling was built in 1961 (assessors records),and is therefore afforded protection with a coastal engineered structure under the WPA. Project Description The purpose of this project is to remove the existing shorefront protection and replace it with a properly designed short rock revetment.No increase in height is proposed from the existing shorefront protection.The installation will provide toe stones set deep enough so that no shifting will occur.The revetment will get overtopped in storms, but will remain stable and intact.All of the work is above the MHW line.No work to the dock is proposed at this time,and no dredging is proposed.Access will be over the applicant’s property,with storage of materials in the yard (lawn)or driveway.See attached construction protocol and project plans for reference. Alternatives Analysis (Discussion of Options) The project is proposed to remove an archaic installation of shorefront protection and replace with a properly designed short rock revetment.The project is located on Coastal Bank and a small amount of coastal beach. Option 1: Do nothing. If nothing is done at this site,the current installation will continue to deteriorate,causing materials to enter the waterway.The vegetated buffer strip would be more prone to erosion and eventually succumb to the erosion.The poles that aren’t anchored could get into the waterway and become a hazard to boaters.Therefore,this option was not chosen. Option 2: Install a vertical bulkhead/seawall in place of the revetment. A vertical bulkhead does not absorb wave energy and reflects it back onto the beach area,liquifying the beach soils,allowing it to be taken away and eroded more quickly.While initially the structure would leave more beach area,the resulting erosion would cause a drop in the beach and the eventual loss of the beach.Therefore this option was not chosen. Option 3: Raise the height of the revetment. This option would raise the revetment to some elevation higher than the back yard.This would create a “bathtub” during flooding events because the flood water could not escape from where it came in from.The flood waters could then be directed to other parts of the property or to the abutting properties,which is against the regulations. This option applies to both a rock revetment or a bulkhead/seawall.Raising the structure would not decrease flooding,since flood waters would just come in from the sides of the properties.Therefore raising the structures beyond what exists provides no benefits and likely causes redirection of flood waters,and therefore is not the chosen option. Flat faced revetments are just that;flat facing stones without the “points out”design which leaves a relatively smooth faced revetment.Because of their smoothness,smooth faced revetments do not absorb some of the wave energy,causing the waves to run up the revetment more than rough faced revetments.These types of revetments get overtopped more easily,causing more frequent erosion at the top or behind them.Therefore,this option wasn’t chosen. Option 5: Project as Proposed;rough faced revetment at the same height as existing. The project as proposed reduces existing negative impacts from the existing shorefront protection by reducing the potential for debris to enter the waterway,and erode behind the structure.The sloping “rough faced” revetment will absorb more wave energy,reduce overtopping events,and will not redirect flood waters to unwanted areas.The revetment can be reconstructed from the land,with no heavy equipment on the beach. Some of the vegetated buffer strip will be temporarily impacted,but can be replanted and stabilized within a year.Therefore,for all the benefits for the desired proposal,this option was chosen. Performance Standards The work associated with this application is limited to the removal an archaic installation of shorefront protection and replace with a properly designed short rock revetment.The project is located on Coastal Bank and a small amount of Coastal Beach.The areas potentially affected by the project include Land Subject To Coastal Storm Flowage,Coastal Bank,and Coastal Beach.Each area is addressed below. Land Subject to Coastal Storm Flowage (LSCSF)—LSCSF is considered a resource area under 310 CMR 10, section 10.02 (1)d.The work proposed in this area is limited to the access for the project and the vegetated buffer strip.These can be restored after construction with only temporary impacts.Any areas disturbed during implementation of the project will be returned to their pre-construction condition.No significant negative impacts to this interest are proposed either in the interim or during the construction effort. Coastal Bank -The area of work over the coastal bank extends from LSCSF 7 feet seaward to the coastal beach. The revetment is in most of this area.The revetment will be reconstructed in segments so that no large portion is open to storms.The bank is considered a vertical buffer to storms,and not a sediment source for down drift beaches.Because this is a south facing shore on a peninsula and with the ferry traffic,there is a good source of sediment along this stretch of beaches.The project will be conditioned to prevent negative impacts to the bank. No negative impacts are anticipated.Therefore,the project as proposed can be permitted under 310 CMR 10.30 (6)through (8). Coastal Beach —The area of coastal beach extends from the base of the rocks approximately 91 feet to MLW.The revetment width is about 1.5 feet of the beach area,above MHW.The proposed revetment construction is designed in accordance with,and meets all regulatory guidelines and therefore will not change the role for the beach in storm damage prevention,flood control,or protection of wildlife habitat.The revetment will also not change the volume or form of the beach sediments,the ability of the beach to respond to wave action,or the effect for any downdrift beach from the current conditions.The revetment,as designed will have no adverse impacts to the coastal beach,and therefore meets the performance standards for work on a Coastal Beach.Therefore,the project as proposed can be permitted under 310 CMR 10.27 (1)through (7). The work area shall be kept to a minimum.All equipment shall be stored on the applicant’s property when not in use.It is anticipated that only a small excavator is needed to replace the stones.The revetment will be reconstructed in sections so that no large portion can be subjected to erosion from storms. Pre-Construction Meeting Prior to construction,a pre-construction meeting shall be held on-site with the Contractor,Property Owner, and the Conservation Commission and/or agent.The purpose of the meeting is to clearly delineate the limits of work and access,as well as the staging area.The Contractor will describe the proposed means and methods for performing the work within the requirements of the plans,order of conditions and construction protocol. The Contractor will comply with mitigation measures as established by the Conservation Commission. To be discussed at this meeting: Existing property conditions,necessary precautions to be taken by the Contractor; Means and methods for construction; Necessary post-construction reparations and conditions; Procedure for post-construction inspection; Shorefront Consulting's responsibilities for inspection and project coordination During Construction,the site shall be accessible for inspection during reasonable hours by all parties, members of the conservation commission and their agents,and the Project Manager. Post-construction meeting Upon completion of construction,but prior to equipment being removed from the site,a post-construction meeting shall be held on-site with the Contractor,Property Owner,and Conservation Commission and/or agent.The purpose of this meeting is to determine that the project has been satisfactorily completed in accordance with all permits,and that no additional work or mitigation is required by the Contractor. Restoration of project area Upon completion of construction,the driveway,beach,staging areas and any other areas disturbed by the construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of the property owner and conservation agent.All disturbed vegetated areas shall be re-vegetated with matching vegetation to match pre-construction conditions for the surrounding areas,or as determined during the pre-construction meeting.
