East Wareham, Massachusetts 02538 Ph. 508-273-0377—Fax 508-273-0367 1 May 13, 2024 Town of Barnstable Conservation Commission 200 Main Street Hyannis, MA 02601 RE: Notice of Intent for 142 Great Bay Road, Osterville, MA Dear Members of the Commission: Please find enclosed a Notice of Intent of the Wetlands Protection Act and Chapter 237 of the Town of Barnstable General Ordinances, accompanied by supporting drawing entitled “Proposed Site Plan” for 142 Great Bay Road Osterville, MA, dated May 10, 2024, for your review and approval. The project involves removing two existing stoops, patios & walkways located on the front of the dwelling on the subject property, construction of a new covered porch with slate paver patios & walkways, and mitigation planting. Relation of Proposed Work to Resource Areas The majority of the proposed work occurs within the 100-ft buffer zone to a bordering vegetated wetland (salt marsh), however all proposed hardscaping occurs on the non- wetland side of the dwelling as shown on the aforementioned support drawing. The entire property, and therefore all the proposed work, is located within Land Subject to Coastal Storm Flowage (FEMA Flood Zone AE, EL. 12). Generally, the land downgradient of the proposed work slopes away from the wetland resource area and towards the paved surface of Great Bay Road. The minimum setback of the proposed work to the salt marsh is 59.0’. Hardscaping & Mitigation Planting In accordance with Chapter 704 of the Barnstable Conservation Commission Regulations the proposed hardscaping within the 100-ft buffer zone will require mitigation planting. The project involves the removal of 408 S.F. of hardscaping and the addition of 975 S.F. of new hardscape, therefore the net hardscape area is +567 S.F. The 3:1 planting ratio would then require 1,701 S.F. of mitigation area. Due to the unique characteristics of the subject property and dwelling location we believe providing 1,290 S.F. (75.8% of required) of effective mitigation area represents maximum feasible compliance with this requirement. Therefore, we are requesting the commission grant a partial waiver to meet the requirements of 704-3.D. We would note the following justifications: 1. All remaining previously disturbed land within the 50-ft buffer zone will be converted to mitigation area. 142 Great Bay Road May 13, 2024 Page 2 2. All remaining previously disturbed land that slopes towards the wetland resource areas will be converted to mitigation area. 3. Any proposed land disturbance (i.e., removal of patios walkways, installation of sonotube footings) is located on the non-resource area side of the dwelling. An erosion control barrier will be installed northerly of the proposed work area as an additional protective measure against sedimentation.
