I am very grateful and will fulfill the agreement and have a surveyed site plan submitted in 90 days or less. Is there a formal commitment letter needed? I was told by the licensing department that I also needed to get you the business certificate. I am attaching it, but I had a question. I wanted to open Cape Quality Car Sales under Cape Quality Collisions S-Corp as a dba possibly. So I am not sure if I filled it out correctly. Thank you again for your time Mr. Florence.   Damion Murray 508-744-7381     On 2020-05-28 15:59, Florence, Brian wrote:   Hi Mr. Murray,   Thank you for your email.  We are happy to hear that you are looking to expand your business and wish you every success.  I am sorry to have to inform you that the Town of Barnstable stopped approving hand drawn site plans in 2017.  In order for me to sign off on the site plan officially it will need to be drawn and stamped by a Massachusetts Registered Land Surveyor.   That said, I understand that you have a timing issue and that the purchase of the property likely hinges on your licensing approval.  As I stated we wish you every success so I would be willing to let the Licensing Authority know that we would allow you to proceed with the licensing process (using the hand drawn document temporarily).  But before I agree to that you would need to submit a commitment letter agreeing to submit a surveyed site plan within 90 days of the hearing.    If I agree to that, you need to understand that if a stamped survey drawing is not received within 90 days we will ask the Licensing Authority to conduct a disciplinary licensing hearing in which we would recommend revocation of the license.    You should also understand that the reason the Town does not accept hand drawn documents is because they are highly inaccurate.  If the surveyor delivers a drawing that shows that the parking lot cannot be used in the manner that the hand-drawn copy depicts then you will need to adjust your business practices and parking lot to comply with the surveyors drawing.    Finally, if the surveyor's drawing is different from the hand-drawn submittal, you may be required to attend a Site Plan Review hearing and comply with any changes that are recommended from the committee.   Some of what I wrote may be foreign to you so if you would like to have a telephone discussion to clarify what I have said then please feel free to leave your email in response to this reply and I will call you to discuss.   Thanks, Brian Florence, Building Commissioner Town of Barnstable 200 Main Street Hyannis, MA 02601 (508) 862-4038 Brian.florence@town.barnstable.ma.us       From:dm@capequalitycollision.com [mailto:dm@capequalitycollision.com] Sent: Thursday, May 28, 2020 11:04 AM To: Florence, Brian Subject: 455 Yarmouth Road hyannis, ma   Hi Mr. Florence, My name is Damion Murray. First and foremost I hope you and your family are safe and healthy. I currently own Cape Quality Collision, an auto body shop in West Barnstable. We would love to expand our business and offer auto sales. 455 Yarmouth RD in Hyannis became available for rent yesterday. I have immediately since then been trying to get all my paperwork together so that I can get it all to the licensing board before the deadline on Monday. I have attached an approved plan that the license department of Barnstable currently has on file for 455 Yarmouth RD. I would like to apply for a Class II Auto Dealer License for this location. The property will not be changing, its being leased turn key. There is a hearing before the town on June 15 that I would love to attend and get approval of my new business. One of the things I was told by the licensing board that I need is your sign off on the building plans. As stated earlier I received an approved plan that the department had on file. We will be making no changes. As this matter is extremely time constrained at this time, any expedition of an answer would be immensely appreciated. Thank you so much for you time Mr. Florence, again I hope all is well with you and yours. Damion Murray 972 Main Street West Barnstable, MA 02668 508-744-7381
