As set forth in the Variance Criteria #3, The applicant designed and submitted
plans for the building including the subject lighting (now illegal sign), which were
approved, ordered and installed in accordance with the approved plans.
After receiving the enforcement notice from the Building Commissioner, the
applicant installed a dimmer system and reduced the lighting level (brightness) by
50%.
Applicant proposes the following condition.
Any use of the sign shall be restricted so that the illumination (brightness) of
the sign shall never exceed 50% of the maximum illumination capacity
(brightness) of the sign as presently installed.
