The ADA requires that newly constructed and altered state and local government facilities, places of public o J , }e accommodation, and commercial facilities be readily accessible to, and TRANSFER SYSTEM usable by, individuals with disabilities. The ADA Accessibility Guidelines (ADAAG) is the standard applied to buildings and facilities. Recreational facilities, including swimming pools, wading pools, and spas, are among the facilities required to comply with the ADA. The Access Board issued accessibility guidelines for newly constructed and altered recreation facilities in 2002. The recreation facility guidelines are a supplement to ADAAG. As a supplement, they must be used in conjunction with ADAAG. References to ADAAG are mentioned throughout this summary. Copies of ADAAG and the recreation facility accessi- bility guidelines can be obtained through the Board's website at www.access-board.gov or by calling 1-800-872-2253 or 1-800-993-2822 (TTY). A SUMMARY OF ACCESSIBILITY GUIDELINES FOR RECREATION FACILITIES - 1 accessible swimming pools and spas Once these guidelines are adopted by the Department of Justice (DOJ), all newly designed, constructed and altered recreation facilities covered by the ADA will be required to comply. The recreation facility guidelines cover the following facilities and elements: ■ Amusement rides ■ Exercise equipment ■ Boating facilities ■ Bowling lanes ■ Fishing piers and platforms ■ Shooting facilities ■ Miniature golf courses ■ Swimming pools, wading pools, ■ Golf courses and spas This guide is intended to help designers and operators in using the accessibility guidelines for swimming pools, wading pools, and spas. These guidelines establish minimum access- ibility requirements for newly designed or newly constructed and altered swimming pools, wading pools, and spas. This guide is not a collection of swimming pool or spa designs. Rather, it provides specifications for elements within a swimming pool or spa to create a general level of usability for individuals with disabilities. Emphasis is placed on ensuring that individuals with disabilities are generally able to access swimming pools and spas and use a variety of elements. Designers and operators are encouraged to exceed the guidelines where possible to provide increased accessi- o r� ,1 bility and opportunities. Incorporating accessibility into the design of a swimming pool or spa should begin earl x g gp p g y in the planning process with careful consideration to the z „* accessible routes and means of entry into the water. The recreation facility guidelines were developed with significant public participation. A large pool is defined as any pool with over 300 linear feet of pool wall. Pool walls at diving areas and in - areas where swimmers cannot enter because of landscap- ing or adjacent structures are still counted as part of the pool's total linear feet. The primary means of entry must be either a sloped entry into the water or a pool lift that is capable of being independ - - 75 F9ET ently operated by a person with a disability. The secondary means of entry could be a pool lift, sloped entry, transfer ' ` •' rt wall, transfer system, or pool stairs. It is recommended that TWO MEANS OF ACCESS REOUIRED IN LARGER POOL where two means of entry are provided, they be different types and be situated on different pool walls. Pools with less than 300 linear feet of pool wall are only required to provide one accessible means of entry, which must be either a pool lift or sloped entry. An accessible means of entry or exit is not required into the catch pool. However, an accessible route must connect to the edge of the catch pool. o i INDIVIDUAL ENTERING Wading Pools A WAVE ACTION POOL A wading pool is a pool designed for shallow depth and is used for wading. Each wading pool must provide at least one sloped entry into the deepest part. Other forms of entry may be provided as long as a sloped entry is provided. The sloped entries for wading pools are not required to have handrails. Spas 'a �r Spas must provide at least one accessible means of entry, which can be a pool lift,transfer wall, or transfer system. If spas are provided in a cluster, 5 percent of the total—or at least one spa—must be accessible. If there is more than one cluster, one f - spa or 5 percent per cluster must be accessible. Footrests are not required on pool lifts provided at spas. However, lift seats must be a minimum of 16 inches wide. In the raised (load) position, the centerline of the seat must be located over the deck, a minimum of 16 inches from the edge of the pool. The deck surface between the centerline of the seat and the pool edge cannot have a slope greater than 1:48. Although not required, seats with backs will enable a larger number of persons with disabilities to use the lift independ- ently. Pool lift seats made of materials that resist corrosion, that provide a firm base, and that are padded are more usable. The Board,when determining whether there is a need for one or more lifeguards and the number of on-duty lifeguards to be present at the pool at any one time,shall take into account the size,shape and capacity of the swimming or wading pool. As a guideline,it is suggested that one lifeguard be provided for each 25 bathers. All lifeguards shall hold the following certifications: (a) A current Red Cross Lifeguard Training Certificate,or Royal Bronze Medallion,or Boy Scouts of America Lifeguard Certificate or National Y.M.C.A. Lifeguard Certificate or an equivalent certification, provided 4__ however,that no such alternative certification shall be deemed equivalent unless it shall contain all of the minimum requirements mandated or required by one or more of the foregoing certification programs;and (b) A current American Red Cross CPR Certificate for the Professional Rescuer or American Heart Association CPR Certificate for the Health Care Provider,or National Safety Council CPR Training;and (c) A Red Cross Standard First Aid Certificate, or a Red Cross Community First Aid and Safety Certificate (which certification may be evidenced by a notation on the back of any Red Cross Lifeguard Training Certificate),or National Safety Council First Aid Training,Level 2,or an equivalent certification,provided however,that no such alternative certification shall be deemed equivalent unless it shall contain all of the minimum requirements of one of the foregoing certification programs. (2) If no lifeguards are required by the Board of Health,a warning sign shall be posted in a conspicuous location and shall state"WARNING-NO LIFEGUARD ON DUTY" in easy to read,legible letters which are at least four inches.(ten cm) high. In addition,there shall be signs which are readily visible stating"CHILDREN UNDER AGE 16 SHOULD NOT USE SWIMMING POOL WITHOUT AN ADULT IN ATTENDANCE" and "ADULTS SHOULD NOT SWIM ALONE." (3) The number of trained lifeguards determined necessary by the Board of Health in accordance with 105 CMR 435.23(1) shall be in constant attendance during bathing hours and no bather shall be admitted to the swimming pool unless this number of lifeguards is present. (4) All lifeguards while on duty shall wear a red or bright orange bathing suit. Any shirt or jacket worn as an outer garment by a lifeguard shall also be red or bright orange and have the word GUARD printed in 4" lettering on the back. An orange hat or sun helmet shall be worn by all lifeguards out-of-doors while on duty. A sunblock or other skin protection should be made available to all lifeguards. (5) The operator shall provide whistles and bull homs or other appropriate voice amplification devices to all lifeguards on duty. (6) All lifeguards shall direct their attention to all persons in their assigned areas while on duty. For swimming pools with a bather load capacity of greater than 75, it is recommended that lifeguards be isolated from pool crowds by occupying elevated seats on stands high enough to give them complete and unobstructed views of persons in their assigned areas.
