Barnstable Marine Service was accumulating containers of hazardous waste and waste oil, which were either not labeled or incompletely labeled. This constitutes a condition of noncompliance with 310 CMR 30.353(6)(g) and 310 CMR 30.253(5)(b),which reference 310 CMR 30.351,which in turn reference 310 CMR 30.340(1)(b). Therefore, within five (5) days of receipt of this Notice, Barnstable Marine Service shall ensure that all waste containers are labeled with the following: a. The words "Hazardous Waste", b. The name of the waste in words (e.g.waste oil,waste gasoline); and C. The type of hazards associated with the waste identified in words (e.g. toxic,ignitable). 2. Some of the containers referenced above were not closed, in violation of 310 CMR 30.353(6)(g)which in turn references 310 CMR 30.685(1). ' Therefore, within one (1) day of receipt of this Notice, Barnstable Marine Service shall ensure that all containers remain closed except when waste is added or removed. 3. Barnstable Marine Service failed to keep a container of paint thinner covered when not in use.
