Dear Ms. Malkus:
Thank you for taking the time to speak with me regarding the discharge of the sump
pump at our house on George Street. As I explained to you Monday, when I was at the
house in late October,I noticed there was a problem. At that time the sump pump was
totally disconnected and there will be no discharge of water during the winter months.
Prior to running the sump pump in the spring of 20111 will investigate your suggested
remedies of a rain garden, wetland pocket, or bio-swale. Ultimately, we will rectify this
problem so that there will be no surface discharge of water on our property which will
stop the discharge of water on Harbor View Road.

Your property in Barnstable on 95,George St. requires your attention regarding
flooding from the property entering Harbor View Road. The flooding from your property
is causing erosion and road damage. This is in violation of the Town of Barnstable's _
general ordinance 206-3, which states: "No person shall allow any sink or other impure
liquid to run from the house,barn or lot,occupied by him into any street of the Town.
(Water from a basement is considered impure, because it may pick up contaminants from
the basement/crawl space.)
In order to remediate this situation I recommend an infiltration swale or dry well, .
which will redirect the basement waters. Your lot is small, so there is not much room for
infiltration. A bio-swale with wetland plants may help with water uptake.
For now, if you cooperate with the Town to resolve this.matter, there will be,no legal
action regarding the violation. However, if we.do not hear from you regarding your plans
to fix the problem, and if we do not see action to address the flooding in the street from
your basement/crawl space,this could result in the issuance of$100 non-criminal ticket
citations.
