Dear Mr. McKean:
Late last week I telephoned your office regarding the installation of the sewer at
the property we rent in Independence Park. I telephoned you at the suggestion of
Tom Mullen, Superintendent of Public Works, who stated that you would be the
person to grant us an extension of the installation deadline of July 1 , 1995.
The reason we are requesting an extension of 90 days is that we did not receive
the betterment notices and other information in time for our current fiscal year
(which ends June 30, 1995) budgeting process, therefore we were unable to
budget for this expense. However, we will have the funds allocated for our new
year beginning July 1 , 1995 in order to complete the installation in the first quarter
of our fiscal year.
We are hoping that you will grant our request for this extension. If you.have any
questions, please do not hesitate to contact me at 508 771 9400, ext. 7336.

AND
NOTICE OF NONCOMPLIANCE
1. THE PARTIES
1. The Department of Environmental Protection("Department" or"MassDEP") is a duly
constituted agency of the Commonwealth of Massachusetts established pursuant to
M.G.L. c. 21A 7. MassDEP maintains its principal office at One Winter Street,

Boston,Massachusetts 02108,and its Southeast Regional Office at 20 Riverside Drive,
Lakeville, Massachusetts 02347.
2. SencorpWhite,Inc. ("Respondent")is a Delaware Corporation with a place of business at
400 Kidds Hill Road, Hyannis,Massachusetts 02601 ("Facility").
H. STATEMENT OF FACTS AND LAW
3. MassDEP is responsible for the implementation and enforcement of:
M.G.L.c. 111, §§ 142A-1420 and the Air Pollution Control Regulations at 310 CMR 6.00,
310 CMR 7.00,310 CMR 8.00;and Hazardous Waste Regulations at 310 CMR 30.000;
MassDEP has authority under M.G.L. c. 21 A, § 16 and the Administrative Penalty
Regulations at 310 CMR 5.00 to assess civil administrative penalties to persons in
noncompliance with the laws and regulations set forth above.
4. Respondent at the time of the inspection was registered with MassDEP as a Very Small
Quantity Generator("VSQG") of hazardous waste and a Small Quantity Generator
("SQG")of waste oil with an EPA Identification No. MAD985266469.

5. The following facts and allegations have led MassDEP to issue this Consent Order:
A. On August 22,2017,MassDEP personnel conducted a multi-media inspection of
Respondent's Facility. The purpose of the inspection was to determine the status
of the Respondent relative to compliance with the Massachusetts Air Pollution
Control Regulations as contained in 310 CMR 7.00,the Massachusetts Hazardous
Waste Regulations as contained in 310 CMR 30.000,the Massachusetts Toxic
Use Reduction Regulations as contained in 310 CMR 50.00 and the
Massachusetts Water Pollution Control Regulations as contained in 314 CMR
2.00-18.00.
The inspection revealed the following violations:
HAZARDOUS WASTE MANAGEMENT
B. While being registered as a VSQG of hazardous waste, Respondent generated
SQG amounts of hazardous waste multiple times during 2015 and 2016 based on
a review of hazardous waste manifests and electronic monthly operating reports.
As such,the Respondent was acting out of status in violation of 310 CMR
30.353(3).
On August 28,2017,Respondent submitted a generator registration form to change
status from VSQG to SQG.
C. While being registered as a SQG of waste oil,Respondent generated Large
Quantity Generator("LQG") amounts of waste oil multiple times during 2016 and
2017 based on a review of hazardous waste manifests and electronic monthly
operating reports. As such,the Respondent was acting out of status in violation of
310 CMR 30.351(7).
On August 28,2017,Respondent submitted a generator registration form to change
status from SQG to LQG.
D. Respondent failed to make a waste determination of the wastewater generated from
the rinse and wash tanks of the parts washer in violation of 310 CMR 30.302.
On October 11,2017,Respondent submitted the analysis report on the wastewater
from the parts washer which indicated the waste streams were non-hazardous.
E. Respondent failed to provide sufficient aisle spacing for container storage of
hazardous waste so that the owner/operator or the Department can inspect each row
of containers to ensure compliance with 310 CMR 30.680 in violation of 310 CMR
30.351(8)(b), which references 310 CMR 30.342 and 310 CMR 30.685.

On August 30,2017,Respondent shipped off-site the thirteen(13)drums of
hazardous waste stored in the hazardous waste accumulation area,thereby creating
sufficient space..
F. Respondent failed to properly label containers of universal waste(fluorescent bulbs),
in violation of 310 CMR 30.1034(5)(e).
On August 22,2017,the containers of universal waste were properly labeled.
G. Respondent failed to maintain a"Designated Facility to Generator"copy of the
following HVN'Manifests:#001215341 VES,#008351955 FLE,4009034997 FLE,
4009533757 FLE,#009533758 FLE and#009578846 FLE,in violation of 310
CMR 30.33l(1),as referred to by 310 CMR 30.253(6)(b)and 30.351(10)(f).
On September 5,2017,the Respondent submitted the"Designated Facility to
Generator"copies of the HW Manifests identified above.
AIR POLLUTION CONTROL
H. Respondent failed to apply for the appropriate Plan Approval while generating
emissions greater than one ton per year of Acetone in violation of 310 CMR 7.02(4).
III. DISPOSITION AND ORDER
For the reasons set forth above,MassDEP hereby issues,and Respondent hereby consents to,this
Order:
6. The parties have agreed to enter into this Consent Order because they agree that it is in

their own interests, and in the public interest,to proceed promptly with the actions called
for herein rather than to expend additional time and resources litigating the matters set
forth above. Respondent enters into this Consent Order without admitting or denying the
facts or allegations set forth herein. However, Respondent agrees not to contest such
facts and allegations for purposes of the issuance or enforcement of this Consent Order.
7. MassDEP's authority to issue this Consent Order is conferred by the Statutes and
Regulations cited in Part II of this Consent Order.
8. Respondent shall perform the following actions:
AIR POLLUTION CONTROL
A. Within thirty(30) days of this Consent Order,Respondent shall submit an
appropriate plan application to MassDEP, in accordance with 310 CMR 7.02.

9. Except as otherwise provided,all notices, submittals and other communications required i
by this Consent Order shall be directed to:

Such notices, submittals and other communications shall be considered delivered by
Respondent upon receipt by MassDEP.
10. Actions required by this Consent Order shall be taken in accordance with all applicable
federal, state, and local laws,regulations and approvals. This Consent Order shall not be
construed as,nor operate as,relieving Respondent or any other person of the necessity of
complying with all applicable federal, state, and local laws,regulations and approvals.
11. For purposes of M.G.L. c. 21A, § 16 and 310 CMR 5.00,this Consent Order shall also
serve as a Notice of Noncompliance for Respondent's noncompliance with the
requirements cited in Part II above. MassDEP hereby determines, and Respondent
hereby agrees,that any deadlines set forth in this Consent Order constitute reasonable
periods of time for Respondent to take the actions described.
12. Respondent shall pay to the Commonwealth the sum of three thousand two hundred
and forty-five dollars($3,245.00)within thirty(30)days of the effective date of this
Consent Order as a civil administrative penalty for the violations identified in Part II
above. This penalty includes one thousand two hundred and ninety dollars ($1,290)
of past due annual compliance fees.
13. Respondent understands, and hereby waives, its right to an adjudicatory hearing before
MassDEP on,and judicial review of,the issuance and terms of this Consent Order and to
notice of any such rights of review. This waiver does not extend to any other order
issued by the MassDEP.
14. This Consent Order may be modified only by written agreement of the parties hereto.
15. The provisions of this Consent Order are severable,and if any provision of this Consent
Order or the application thereof is held invalid, such invalidity shall not affect the validity
of other provisions of this Consent Order, or the application of such other provisions,
which can be given effect without the invalid provision or application,provided however,
that MassDEP shall have the discretion to void this Consent Order in the event of any
such invalidity.

16. Nothing in this Consent Order shall be construed or operate as barring,diminishing, j
adjudicating or in any way affecting(i) any legal or equitable right of MassDEP to issue
any additional order or to seek any other relief with respect to the subject matter covered

by this Consent Order,or(ii)any legal or equitable right of MassDEP to pursue any other
claim,action, suit,cause of action,or demand which MassDEP may have with respect to
the subject matter covered by this Consent Order,including,without limitation,any
action to enforce this Consent Order in an administrative or judicial proceeding.
17. This Consent Order shall not be construed or operate as barring,diminishing,
adjudicating,or in any way affecting, any legal or equitable right of MassDEP or
Respondent with respect to any subject matter not covered by this Consent Order.
18. This Consent Order shall be binding upon Respondent and upon Respondent's successors
and assigns. Respondent shall not violate this Consent Order and shall not allow or suffer
Respondent's directors, officers, employees, agents, contractors or consultants to violate
this Consent Order. Until Respondent has fully complied with this Consent Order,
Respondent shall provide a copy of this Consent Order to each successor or assignee at
such time that any succession or assignment occurs.
19. In addition to the penalty set forth in this Consent Order, if Respondent violates any
provision of the Consent Order,Respondent shall pay stipulated civil administrative
penalties to the Commonwealth in the amount of$500 per day for each day, or portion
thereof, each such violation continues.
Stipulated civil administrative penalties shall begin to accrue on the day a violation
occurs and shall continue to accrue until the day Respondent corrects the violation or
completes performance,whichever is applicable. Stipulated civil administrative penalties
shall accrue regardless of whether MassDEP has notified Respondent of a violation or act
of noncompliance. All stipulated civil administrative penalties accruing under this
Consent Order shall be paid within thirty (30)days of the date MassDEP issues
Respondent a written demand for payment. If simultaneous violations occur, separate
penalties shall accrue for separate violations of this Consent Order. The payment of
stipulated civil administrative penalties shall not alter in any way Respondent's
obligation to complete performance as required by this Consent Order. MassDEP
reserves its right to elect to pursue alternative remedies and alternative civil and criminal
penalties which may be available by reason of Respondent's failure to comply with the
requirements of this Consent Order. In the event MassDEP collects alternative civil
administrative penalties,Respondent shall not be required to pay stipulated civil
administrative penalties pursuant to this Consent Order for the same violations.
Respondent reserves whatever rights it may have to contest MassDEP's determination that
Respondent failed to comply with the Consent Order and/or to contest the accuracy of
MassDEP's calculation of the amount of the stipulated civil administrative penalty.Upon
exhaustion of such rights,if any,Respondent agrees to assent to the entry of a court
judgment if such court judgment is necessary to execute a claim for stipulated penalties
under this Consent Order.

20. Respondent shall pay all civil administrative penalties due under this Consent Order,
including suspended and stipulated penalties, by certified check, cashier's check,or
money order made payable to the Commonwealth of Massachusetts, or by electronic
funds transfer. If payment is made by certified check,cashier's check, or money
order, Respondent shall clearly print on the face of its payment Respondent's full
name,the enforcement document number appearing on the first page of this
Consent Order,and Respondent's Federal Employer Identification Number, and
shall mail it to:

In the event Respondent fails to pay in full any civil administrative penalty as required by
this Consent Order,then pursuant to M.G.L. c. 21A, § 16, Respondent shall be liable to
the Commonwealth for up to three(3)times the amount of the civil administrative
penalty,together with costs,plus interest on the balance due from the time such penalty
became due and attorneys' fees, including all costs and attorneys' fees incurred in the
collection thereof. The rate of interest shall be the rate set forth in M.G.L. c. 231, § 6C.
21. Failure on the part of MassDEP to complain of any action or inaction on the part of
Respondent shall not constitute a waiver by MassDEP of any of its rights under this
Consent Order. Further, no waiver by MassDEP of any provision of this Consent Order
shall be construed as a waiver of any other provision of this Consent Order.
22. To the extent authorized by the current owner, Respondent agrees to provide MassDEP,
and MassDEP's employees,representatives and contractors,access at all reasonable
times to Respondent's Facility for purposes of conducting any activity related to its
oversight of this Consent Order. Notwithstanding any provision of this Consent Order,
MassDEP retains all of its access authorities and rights under applicable state and federal
law.
23. This Consent Order may be executed in one or more counterpart originals, all of which
when executed shall constitute a single Consent Order. f
24. Respondent's obligations under this Consent Order shall cease upon Respondent's
completion of all actions and payments required pursuant to Paragraphs 8 through 23 of this
Consent Order and MassDEP's issuance of a return to compliance letter stating that
Respondent has completed the requirements of said Paragraphs.

25. The undersigned certify that they are fully authorized to enter into the terms and
conditions of this Consent Order and to legally bind the party on whose behalf they are
signing this Consent Order.

Keith, On Thursday, October 6, Mr.Timothy Lavelle, Hazardous Materials Specialist for the Department
of Regulatory Services with the Town of Barnstable,visited us for his annual inspection of our facility.
Overall we did not do too bad. We had no violations but he listed a few recommendations. He did see an
improvement in the reduction of product in the paint storage room. But, he never received copies of 3
months of Hazardous Waste Manifests that he requested during his last visit ( 8-19-15).
I secured a copy of his 2015 visit and noticed several repeat recommendations compared to this years
inspections.
Detailed below are my notes documenting areas of concern that need to be addressed;

Spill Containment pallets in,the Thermoforming area;
We currently utilize 2 spill containment pallets for single
drums of product. Mr. Lavelle is concerned that if these are
transported by a forklift,there is a chance that the forks
could tilt forward and spill the product. I will install straps to
secure the drums to the pallets.
CNC Satellite Storage Area; Spill containment needs to cleaned out. V"� -S�Nt- ►+s-�u�avls ��� ells-�
1 each open 5 gallon pail had used absorbent mats and soiled trash.These
items need to disposed of in a 'DRY' Hazardous Waste Drum to include
any speedy dry. Housekeeping needs attention.Old mats on the floor and
several areas of the floor were oily (slip hazard).
There was a Home Depot 5 gallon pail modified with a spigot with'Trim Tap'
written on it?We were not sure what was going here. I will investigate
and determine the correct containers to use.

Mr. Lavelle would also like to see a spill kit in the area.
Cut Off Area; There were 2 drums of Hazardous Waste queued for removal (4 days away). Mr. Lavelle
suggested that any Hazardous Waste only be queued on the day of removal.
It was recommended that we have a spill kit in this area due to the occasional Hazardous

for scheduled clean- up of any residual sludge
Label on drum ( hazardous waste)of oils skimmed from evaporation was not
readable.
One of the paint cabinet doors was left open.They need to be closed at all times.
Hazardous Waste Manifest; Need copies of last 3 months. The Town requires retention of 5 years of
Hazardous Waste Manifests and the State EPA requires 3 years.

Per Mr. Lavelle's request for immediate attention, Completed the Town of Barnstable Hazardous
Materials Registration Form ( based on a General Hazardous Material Inventory I established
10/6/2016), and compiled a minimum of 3 months of Hazardous Waste Manifests.
Once I have sent all of the documentation to Mr. Lavelle, I will establish an Excel worksheet detailing the
issues to be addressed and the owner of the task.
