' wpaform3.doc-rev.4/12/06 Page 6 of 7 { i PROJECT DESCRIPTION PAYSON SUBDIVISION i The Payson property is a parcel of f3.34 acres lying southerlyof Route 6A and approximately p Y p Y g pP Y 450' west of Mary Dunn Road in the Village of Cummaquid. The land is somewhat rolling rising from elevation f22'NGVD at Rte. 6A to 44' in the central section, falling to±32' before rising again to±54' at the southwest lot corner. The land has been farmed in the past and is predominantly meadow in the central section with a few scattered specimen trees and woodland ' to the rear of the parcel. f There is a small constructed farm/goldfish pond on the easterly neighboring lot, approximately 75' of which is an incursion onto the lot access f70' south of Route 6A. The pond has essentially no wetland plant community component with the exception of a single specimen red maple near the pond's constructed outlet. The outlet runs off the northeast corner of the pond to the north ' and northwest.. At the time of the site visit the pond was±2' below its normal level based on exposed unvegetated sediments. The water level was also below the bottom of the outlet ditch, I ' confirming that this feature could be no more than an intermittent stream. There was neither flowing nor standing water in the outlet at this time. The outlet runs into a culvert which appears to run under Route 6A and into the street drainage system. Anecdotal information provided by both the engineer and the applicant is that the pond is filled artificially. This lends to the ephemeral nature of the entire system. Under 131/40 and 310 CMR 10.04,the section of an intermittent stream up-gradient of all vegetated wetlands is not ' regulatable. Further, bodies of water of less than 10,000 s.f. (310 CMR 4) are too small to be regulatable ponds. The farm pond in question has a surface area of less than 1200 s.f. when full. ' It is,therefore, not a "pond" for regulatory purposes under The Act. i The last way the pond could be regulated under the Act would be as Isolated Land Subject to ' Flooding. To be so regulated, it would need to hold 10,000 cu.ft. of water(1/4 ac.ft.) at least once a year(310 CMR 10.57(2)(b)(1). If the pond had vertical sides it could only hold±7500 �cu.ft.; approximately 25% less than required. Consequently, neither the farm pond nor its outlet ' ditch are subject to regulation under the Act. I The Town Wetland Ordinance has a different definition of surface waterbodies. For the Local I Ordinance, a depression which holds water for at least 5 months a year except during droughts, and regardless of size are regulatable. This definition also specifically excludes intermittent ,streams with no wetland vegetation component. No separate stream definition is provided. Thus,the outlet channel is not regulatable under Local Ordinance, either. i Lastly, is the issue of Maraspin Creek. The freshwater component of this waterway runs north of i and irregularly parallel to Route 6A until it crosses Indian Trail where it subsequently dips south } of Route 6A. For the Payson property, and based on the FEMA Flood Study, as much as the northerly 30' could be within the outlet limits of the 200' Riverfront zone to Maraspin Creek. ' Intervening between the site and the river are: Route 6A and at least one bank of houses with i t i their lawns, septic systems and other amenities. The 30' strip along the north property line is, then, the only area of the property regulatable under the Act. The site contains: no FEMA mapped floodplains; no rare species habitat; and no vegetated ' wetlands. The project is limited to the construction of the access road, the northerly most 30' of which is regulatable under the Act, and the northerly±210' of which is regulatable under the Ordinance. Information on the drainage system is shown on the plans. Drainage calculations are included. The system is designed as a leaching system. It does not connect to the farm pond outlet channel or the Route 6A drainage system. Traps in the basins are designed to catch and retain sediment and floatables. The system is landward of the Riverfront. It meets design criteria for stormwater management insofar as they are applicable to the project. Riverfront Analysis—Because of the location of Maraspin Creek relative to the property frontage, there is no way to avoid utilizing land within the Riverfront for access purposes. The properties immediately to the east and west are already developed with single family dwellings. The westerly lot is non-conforming as to area and therefore could not be subdivided to provide additional frontage for the site. Further, its frontage appears to be in the Riverfront as well. Acquiring it as adjunct to the development would serve no purpose. The easterly section of the east lot may be outside the Riverfront,but to subdivide an access strip 50' wide, the minimum required by Town subdivision regulations, would require±0.44 ac of land which would make the house lot non-conforming. Further,the cost of acquiring the entire developed lot to obtain the 2 buildable lots proposed becomes financially unpractical and would make the project non-viable. The Planning Board has refused to allow an access of lesser dimensions for this site. I Impacts I 131/40—Because the only resource area involved is the Outer Riparian-section of the ' Riverfront and because all drainage is to be located landward of the Riverfront, no significant adverse impacts will accrue under the Act. 1 Local Ordinance—A row of staked haybales will be installed along the east property line within the 100' buffer to the farm pond prior to construction. Also a haybale will be placed I within the outlet ditch near the property line prior to the extension of the existing culvert and construction of the headwall. This barrier will act as erosion/siltation control and as a marker for j construction equipment. The road bank will be grassed to control long-term impacts. i i The proposed street drainage system captures all runoff from paved surfaces, routes it to trapped manholes where sediment and floatables are captured before the water is leached into the ground. ' The system has been reviewed by the Town Engineering Department and approved by the Planning Board. It does not outlet or overflow to any surface waterbody. No significant adverse impacts to surface or groundwater quality or quantity are anticipated. With no areas of the site subject to flooding, no adverse impacts to flood control or storm damage prevention are anticipated. The area is not mapped for rare plants or animals and none have been observed at the sit during ' field work. The work area is substantially cleared now. There is no natural or native vegetation on the farm pond bank to provide significant habitat. The pond is apparently stocked with goldfish by the owner. No impacts to protectable wildlife habitat, shellfish or fisheries interests are anticipated. The work area is already utilized as access. Its narrow shape and the access make it unsuitable for agriculture. ' As private property, the site has no public recreation function and no impact to this interest is anticipated. ' The access improvements will be regulated for aesthetics by the Old Kings Highway Historic Committee. No historic or archaeological resources are known to occur in the work area. However, a certified archaeologist will be on-call during construction. The applicant presented drainage along Payson Lane at two (2) locations and also provided drainage calculations. The width of the road right-of-way is 50 feet; the width of the paved portion of the road is presented at 18 feet in width to include one-foot ' berms on each side. The applicant requested three (3) Waivers. A waiver was requested from Section 5- .14 to allow a 1:1 slope in the area of the stone wall as noted on the plan. Another waiver was requested to reduce the usable shoulder of the road from five (5) feet to-four(4) feet. A waiver was requested from ' the site distance requirements in the Design Standards from 475 feet to 350 feet to the east and 432 feet to the west ofthe intersection of Payson Lane and Route 6A. FIELD NOTES 3799 RTE. 6A, CUMMAQUID ' Payson Subdivision (Our File No. 2.1147.00) • p A site visit was made on the afternoon of 1/12/02 for the purpose of delineating wetlands adjacent ' to a proposed subdivision road. The sky was partly cloudy. The temperature was±45°F. There had been no rain for the previous ' few days. The proposed road is over the access to an existing agricultural field of rolling grasslands with ' occasional wolf trees and wooded upland edges. There is a small,rectangular farm pond or drainage basin off the east side of the entry drive. It outlets through a small sectioned ditch which extends north, northwest of the pond. It empties into a subsurface culvert which may extend under ' Route 6A offsite. t Landscape materials are maintained around the pond with grasses extending to the top of and onto ' the pond banks. A stand of cultivated highbush blueberry has been planted on the west side of the pond. A small group of sumac occur on the west side of the pond. The only actual wetland community materials are a single large specimen red maple at the intersection of the pond and ditch, ' and a couple of disparate clumps of soft rush at the water's edge. Water levels, based on exposed sediments appear to be±18" to 24" below normal. i ' If the pond had been permitted when built, it would likely not be regulatable under 131/40. However, it appears to pre-date.the '83 regulatory revisions and likely needed no permit when originally constructed. It has no regulatable BVW. An Observed Species List is attached.
