The Machine Shop floor is concrete, but the remainder of the building has wood flooring. The Machine Shop and Engine Showroom are storage areas for the majority of hazardous materials. These materials are typically packaged in consumer sized plastic containers and aerosol cans (one gallon capacity or smaller).There is also a Parts Cleaner in the Machine Shop, the waste of which is manifested off site by Safety Kleen. A Spill'Kit is available in the rear of the Machine Shop. The waste oil is stored in a wooden lean-to structure attached to the first building in the . lot, and is clearly labeled. This lean-to can be secured by a lock. The structure contains two fifty-five gallon plastic drums for waste oil storage; the drums'are housed in a large plastic tub which acts as containment. The floor of the lean-to consists of broken asphalt. The lean-to lid is spilt into two doors which do not fit tightly together. This configuration allows rain water to enter the structure and collect in the containment tub.Additionally, the bung holes of the waste oil drums where not plugged which could allow for the accumulation of rain in the drums as well. There were approximately eleven, five gallon covered buckets of unidentified material also stored in the lean-to. The waste oil is manifested off site by Murphy's Waste Oil Service, Woburn, MA. The gasoline pump is located on a wooden deck, and is equipped with a retractable hose system. The hose is manually pulled down the wooden ramp to the floating dock where the boat to be filled is tied. Booms are to be made readily available and permanently stored at the floating dock in JAI"Al such quantity and size so as to contain an accidental spill. A Notice of Activity and Use Limitation(AUL), prepared by Ms. R. Kelly Maman, the former Licensed Site Professional (LSP) and recorded for the site in March 1999, did not contain an AUL Opinion prepared by a LSP, nor did it adequately define the boundaries of the restricted area. On March 14, 2002, the Department issued a Notice of Audit Findings (NOAF) that identified errors in the AUL filed in support of a Response Action Outcome (RAO) for the above-referenced site. The NOAF established an Interim Deadline of September 16, 2002 for submitting documentation of the required corrections accompanied by a Post-Audit Completion Statement. This is an enforceable Interim Deadline issued pursuant to M.G.L. c. 21E, 310 CMR 40.0167 and 310 CMR 40.1140. On October 16, 2002, the Department received an AUL Amendment for the site. The AUL Amendment was prepared by Environmental Impact Services, Inc. and signed by Mr. John Patterson, LSP #6625. However, the AUL Amendment did not correct any of the errors previously identified in the NOAF and was not prepared using the forms and instructions provided by the Department with the March 14, 2002 NOAF. In the NOAF dated March 14, 2002, the Department established an Interim Deadline of September 16, 2002 for providing documentation that the required corrections to the Notice of AUL have been performed. An AUL Amendment was received on October 16, 2002. This is a violation(Class II) of 310 CMR 40.0167. Violation of(1997) 310 CMR 40.1074(1)(b) —An Activity and Use Limitation (AUL) shall be submitted on a form prescribed by the Department and shall specify why the AUL is appropriate to achieve and/or maintain a condition of No Significant Risk, the site activities which are permitted, which activities are restricted and the obligations and conditions necessary to maintain the condition of No Significant Risk. In the NOAF dated March 14, 2002, the Department found that the Notice of AUL submitted for the site on March 1999 did not contain an AUL Opinion prepared by a Licensed Site Professional. An AUL Amendment submitted to the Department on October 16, 2002 did not contain an AUL Opinion. This is a violation(Class II) of 310 CMR 40.1074(1)(b). Violation of (1997) 310 CMR 310 CMR 40.1074(2)(a)2 — A Notice of AUL shall contain a metes and bounds description of the parcel of land which contains the area that is subject to the Notice of Activity and Use Limitation, and if the parcel of land is not registered land, a survey plan of such parcel prepared by a Massachusetts Registered Land Surveyor recorded with the appropriate Registry of Deeds. a + 253 Millway Road,Barnstable Page 2 Notice of Noncompliance RTNs 4-14016 &4-14345 The original AUL recorded in March 1999 did not adequately define the boundaries of the area restricted by the AUL. The AUL Amendment submitted to the Department on October 16, 2002 does not adequately define the boundaries of the AUL Area. Like the original submittal, the "Whereas" clauses in the form are not properly completed, resulting in lack of clarity as to whether all or part of the property is to be restricted. In addition, a metes and bounds description of the area subject to the AUL and a reference to a survey plan were not contained in the AUL Amendment. This is a violation(Class II) of 310 CMR 40.1074(2)(a)2. ACTIONS TO BE TAKEN AND DEADLINE Within sixty (60) days following receipt of this notice, you must implement a Second Amendment and Ratification of Notice of Activity and Use Limitation, using the form and instructions provided with the Notice of Audit Findings (NOAF). The corrective AUL must address the errors outlined in the March 14, 2002 NOAF. Alternatively, you may submit a new Response Action Outcome (RAO) Statement documenting the achievement of a Class A-1, A-2 or B-1 RAO at the site (i.e., an RAO that does not rely on an AUL to maintain a level of No Significant Risk). Please indicate in writing within fourteen (14) days following receipt of this notice whether or not you intend to undertake the required actions. If you fail to correct the violations identified and provide documentation of such action to the Department, you may be subject to enforcement action by the Department. The Method 3 Risk Characterization for the disposal site was not prepared in a manner consistent with scientifically acceptable risk assessment practice and Department guidance. According to 310 CMR 40.0902(2)(b), a Method 3 Risk Characterization compares site specific information to an Excess Lifetime Cancer Risk (ELCR) limit of one-in one hundred thousand in order to determine risk to human health. The Method 3 prepared for the disposal site states that the ELCR calculations did not exceed a value of 1.0. In addition, the calculations used to calculate the ELCR were not provided with the risk characterization. Lastly, an environmental risk characterization was not conducted despite the fact that environmental receptors were identified in the immediate vicinity of the site. This is a violation(Class II) of 310 CMR 40.0901(4). 2. The Method 3 Risk Characterization prepared for the disposal site identified the disposal site as being located within the boundaries in an Aquifer Protection District. Groundwater located within the boundaries of an Aquifer Protection District is categorized as GW-1. The RAO categorized the groundwater at the disposal site as GW-2 and GW-3, saying that the groundwater is naturally brackish due to its proximity to the harbor and therefore, exempt from the GW-1 Status. Department review of the RAO determined that the groundwater at the site was incorrectly categorized. This is a violation (Class II) of 310 CMR 40.0932(4)(b) and 310 CMR 40.0191(1). 3. Department review of the RAO has determined that a condition of No Significant Risk does not exist at the disposal site. Concentrations of benzene, toluene, MtBE and the C9-C 10 VPH fraction detected in the December 1998 sampling event exceed the Massachusetts Drinking Water Quality Standards and Guidelines. Pursuant to 310 CMR 40.0901(4), the characterization of the risk of harm to human health, safety, public welfare and the environment shall be prepared in a manner consistent with scientifically acceptable risk assessment practices, and shall take into consideration guidance published by the Department. 2. Pursuant to 310 CMR 40.0932(4)(b), groundwater shall be categorized as GW-1 if the groundwater is located in a Potential Drinking Water Source Area(PDWSA). Pursuant to 310 CMR 40.0191(1), the Response Action Performance Standard (RAPS) is the level of diligence reasonable necessary to obtain the quantity and quality of information to assess a site and evaluate remedial alternatives, and to design and implement specific remedial actions at a disposal site to achieve a level of No Significant Risk for any foreseeable period of time and, where feasible, to reduce to the extent possible the level of oil and/or hazardous materials in the environment to background levels. 3. Pursuant to 310 CMR 40.0993(7)(a), a condition of no significant risk of harm to human health exists or has been achieved if no Exposure Point Concentration of oil and/or hazardous material is greater that an applicable or suitable analogous public health standard. Pursuant to 310 CMR 40.1035(2)(a), a Class A RAO shall apply where response actions have been conducted to achieve a level of No Significant Risk as specified in 310 CMR 40.0900. ACTIONS TO BE TAKEN AND DEADLINE Within sixty (60) days of receipt of this Notice you must: Submit a Tier Classification Submittal in accordance with 310 CMR 40.0500, and if applicable, a Tier I Permit application package pursuant to 310 CMR 40.0550 in order to continue response actions at the Site in accordance with the MCP. If you fail to comply, the site could be listed as a default Tier 113 site, and you may be assessed a Tier 113 Annual Compliance Fee of $2,600 for response actions that you carry out prior to tier classification. The RAO Submittal was prepared on your behalf by Mr. John H. Patterson as Licensed Site Professional (LSP), License No. 6625. The Department has reviewed documents supporting the RAO in order to ensure that the RAO complies with Massachusetts General Law c.21 E and the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. The Department's audit of this site consisted of a file review. Department staff at the southeast regional office performed the file review audit. BACKGROUND The disposal site is situated on a waterfront lot at 253 Millway Road in Barnstable, Massachusetts. Maraspin Creek is located to the south and west of the property. Millway Road is located to the east and commercial properties are located north of the property. The property is owned and operated by Millway Marina and is used for the storage and repair of boats. Release tracking numbers (RTNs) 4-14016 & 4-14345 were assigned to the property for a release of gasoline that was identified in June 1998. An 8,000-gallon underground storage tank (UST) containing gasoline was excavated from the property in November 1998. Approximately twenty (20) cubic yards of gasoline contaminated soil were removed from the tank excavation. Soil samples were collected from the bottom and sidewalls of the excavation and analyzed for volatile petroleum hydrocarbons (VPH) and target analytes. DEP on the World Wide Web: http://www.mass.gov/dep Printed on Recycled Paper 253 Millway Road,Barnstable MA Page 2 RAO Invalidation RTNs 4-14016&4-14345 wells were installed at the site and sampled for VPH, benzene, toluene, ethlybenzene, and xylenes (BTEX), methyl tertiary butyl ether (MtBE), extractable petroleum hydrocarbons (EPH) and polyaromatic hydrocarbons (PAHs). In May 1999, a Class A-3 RAO was submitted for the disposal site, prepared by the LSP-of-record at the time, Ms. R. Kelly Maman. The A-3 RAO relied upon the implementation of an Activity and Use Limitation (AUL) to ensure that a condition of No Significant Risk was achieved at the site. On March 14, 2002, the Department issued a Notice of Audit Findings (NOAF) that identified errors in the AUL recorded for the property. The NOAF established an Interim Deadline of September 16, 2002 for submitting documentation of the required AUL corrections. On October 16, 2002, the Department received an AUL Amendment for the site. The AUL Amendment was prepared by Environmental Impact Services, Inc. and signed by Mr. John Patterson, LSP #6625. However, the errors previously identified in the NOAF had not been corrected and the AUL Amendment was not prepared using the forms and instructions provided by the Department in the March 14, 2002 NOAF. The Department issued a Notice of Noncompliance (NON) on December 2, 2002, which required that the errors in the original AUL be corrected. In response, the Department received a Class A-2 RAO for the site on February 7, 2003. According to the RAO, a Method 3 Risk Characterization was utilized at the site to document that a condition of No Significant Risk had been achieved at the site. Following Departmental review of the Class A-2 RAO and Method 3 Risk Characterization, it was determined that a condition of No Significant Risk had not been achieved at the disposal site. Specifically,the Method 3 Risk Characterization was not completed in accordance with 310 CMR 40.0000 and does not support a conclusion of No Significant Risk. The groundwater at the disposal site was incorrectly categorized as GW-2 and GW-3. According to the RAO, "although the disposal site lies within an Aquifer Protection District, the groundwater at the disposal site is categorized as GW-2 and GW-3 since the groundwater at the disposal site is naturally brackish due to its proximity to the harbor and therefore, exempt from the GW-1 Status according to 310 CMR 40.0932(5)(b)". This rationale is not applicable and cannot be used to alter the groundwater category at this disposal site since the disposal site is located in an Aquifer Protection District. The correct groundwater categories for the disposal site are GW-I, GW-2 and GW-3. In addition, the groundwater data incorporated in the Method 3 Risk Characterization was collected in December 1998. The levels of benzene,toluene, MtBE and the C9-C 10 VPH fraction reported in the December 1998 sampling event exceeded the Massachusetts Drinking Water Quality Standards and Guidelines. AUDIT FINDINGS In addition to the procedural shortcomings, the Method 3 Risk Characterization for the disposal site failed to identify the proper groundwater classification at the site. Concentrations of gasoline constituents detected in the groundwater at the disposal site exceed the Massachusetts Drinking Water Standards, an applicable or suitably analogous public health standard. Therefore, pursuant to 310 CMR 40.0993(7)(a), the Department has determined that a condition of No Significant Risk of harm to human health does not exist at the disposal site and, as such, the RAO does not comply with the provisions of 310 CMR 40.1000. J� 253 Millway Road,Barnstable MA Page 3 RAO Invalidation RTNs 4-14016&4-14345 DETERNIINATION Pursuant to its authority under 310 CMR 40.0100(1)(e) and 40.1003(2), the Department hereby determines the RAO submittal and LSP Opinion dated January 6, 2003 to be in noncompliance with M.G.L. c.21E and the MCP. Therefore, the RAO submittal is not valid. Because of the above conditions, further assessment and /or remediation in compliance with the MCP must be conducted at the Site until a level of No Significant Risk can be achieved and a valid RAO is submitted to the Department. The activities that are in noncompliance and the actions the Department requires you to take to come into compliance are described in the Notice of Noncompliance (Attachment A). The Notice of Noncompliance describes: (1) each activity identified during the audit which is in noncompliance, (2) the requirements violated, (3) the action the Department requires you to take, and (4)the deadline for taking this action. If you fail to come into compliance by the prescribed deadlines, or if you otherwise fail to comply in the future with requirements applicable to you, you could be subject to legal action. Such action could include criminal prosecution, court imposed civil penalties, or civil administrative penalties assessed by the Department. A civil administrative penalty may be assessed for every day from now on that you remain out of compliance with the requirements described in the Notice of Noncompliance. The law provides for administrative penalties of up to $25,000 per day for certain violations of the MCP through chapter 21A§16 and 310 CMR 5.00. LICENSED SITE PROFESSIONAL A copy of this Notice has been sent to Mr. John Patterson, the Licensed Site Professional (LSP) who prepared the RAO submittal for the site. You may consult with your LSP when preparing a response to this Notice. Note, however, that you, not your LSP, are obligated to respond to this Notice and remedy the specified violations. Failure to correct the identified violations and provide documentation of such action to the Department may subject you and your officers to enforcement action by the Department. The Department may conduct a follow-up audit to determine whether the required actions have been taken.
