The purpose of the follow-up inspection was to verify that the violations cited in the above referenced NON had been satisfactorily corrected. In addition,the Department is in receipt of your written response, dated 7/21/2005. NAME OF ENTITY(S)IN NONCOMPLIANCE: Millway Marina,Inc.,Facility ID#382174 LOCATIONS)WHERE NONCOMPLIANCE OCCURRED OR WAS OBSERVED: 269 Millway Barnstable,MA 02630 DATE(S)WHEN NONCOMPLIANCE OCCURRED OR WAS OBSERVED: J June 16,2005 2 DESCRIPTION OF NONCOMPLIANCE: The Department's investigation shows that your company violated the following requirements: A. Hazardous Waste: 1. Millway Marina is a Very Small Quantity Generator (VSQG) of waste oil from the maintenance of marina equipment and boat engines. The waste oil is accumulating inside a maintenance building in five (5) five gallon containers that were not properly labeled in violation of 310 CMR 30.253(6)(c), 30.353(6)(g) and 30.682. The regulation states: (3) "Throughout the period of storage, the side of each container of hazardous waste shall be clearly marked and labeled in a manner which clearly identifies, in words, the hazardous waste(s)being stored (e.g., acetone, toluene) and the hazard(s) associated with the hazardous waste (e.g., ignitable, toxic, dangerous when wet). Each container shall also be marked clearly with the words "Hazardous Waste"." 2. The accumulation area for.the containers of waste oil was not designated by tape or line on the floor in violation of 310 CMR 30. 253(6)(c), 30.353(6)(h) and 30.341(5). The regulation states: (5) "All areas where wastes are accumulated for purposes of complying with 310 CMR 30.000 generally shall be clearly marked (e.g., by a clearly visible line or piece of tape on the floor, or by a gate or fence, or by a sign at the boundary of a clearly distinguishable area) so that they are clearly distinguishable at all times from all specific points of generation where wastes are initially accumulated solely for purposes of 310 CMR 30.340(6), and from all areas at the site of generation where wastes are not accumulated". 3. The accumulation area for the containers of waste oil was not posted with a sign in violation of 310 CMR 30.253(6)(c). The regulation states: (c) "All Very Small Quantity Generators of waste oil and/or used oil fuel shall comply with 310 CMR 30.353, including all other regulations referred to therein, except that a Very Small Quantity Generator of waste oil and/or used oil fuel need not comply with the signage requirement of 310 CMR 30.341(4) referenced in 310 CMR 30.353(6)(h). Instead, all areas where waste oil and/or used oil fuel is accumulated or stored, except for satellite accumulation areas, shall have posted at all times a sign with the words "WASTE OIL" in capital letters at least one inch high. Each sign shall meet the guidelines set forth in the National Fire Protection Association's Code No. 704". 4. Millway Marina is also a Very Small Quantity Generator (VSQG) of waste gasoline/water. The company was accumulating one drum of said waste outside in an area that did not meet accumulation area standards in violation of 310 CMR 30. 353(6)(h) and 30.341(4&5). The regulations state: (4) "All areas where wastes are accumulated shall have posted at all times a sign with the words "HAZARDOUS WASTE" in capital letters at least one inch high. Each such sign shall meet the guidelines set forth in the National Fire Protection Association's Code No. 704" and (5) "All areas where wastes are accumulated for purposes of complying with 310 CMR 30.000 generally shall be clearly marked (e.g., by a clearly visible line or piece of tape on the floor, or by a gate or fence, or by a sign at the boundary of a clearly distinguishable area) so that they are clearly distinguishable at all times from all specific points of generation where wastes are initially accumulated solely for purposes of 310 CMR 30.340(6), and from all areas at the site of generation where wastes are not accumulated". 5. The drum of waste gasoline/water referenced in item 4. above was not properly labeled in violation of 310 CMR 30.353(6)(g) and 30.682. The regulation states: "Throughout the period of storage,the side of each container of hazardous waste shall be clearly labeled and marked in a manner which identifies, in words,the hazardous waste(s)being stored in the container(e.g., acetone, toluene) and the hazard(s) associated with the waste(e.g.,ignitable,toxic, dangerous when wet). Each container shall also be marked with the words "Hazardous Waste"." 6. The drum of waste gasoline/water referenced in item 4. above was not located on an impervious surface and was without containment in violation'of 310 CMR 30.353(6)(h) and 30.342(1)(e). The regulation states: (e) 310 CMR 30.687: "Containment; except that a generator shall comply with the following in lieu of 310 CMR 30.687(1) and(2): 1. Underlying all containers shall be a base which is free of cracks and gaps and is sufficiently impervious to contain leaks, spills, and accumulated precipitation until the collected material is detected and removed. 2. All outdoor containers shall be provided with a containment system that has the capacity to contain either 10% of the total possible contained volume of the containers, or 110% of the volume of the largest container, whichever is greater". 7. The drum of waste gasoline/water referenced in item 4. above was not located in an area that is secured from unauthorized entry in violation of 310 CMR 30.353(6)(h) and 30.341(3). The regulation states: (3) "All areas where wastes are accumulated shall be operated with appropriate security measures at all times to prevent the unknowing entry of persons, reduce as much as possible the unauthorized entry of persons, and prevent the entry of livestock into such areas". 8. The company registered their hazardous waste generation activity with the Department on May 22, 2003 and was issued the permanent hazardous waste IN W5083624904. However, the company is using a temporary hazardous waste IN on the hazardous waste manifests in violation of 310 CMR 30.311(1). The regulation states: (1) "A generator who transports, or offers for transportation, hazardous waste for off-site treatment, storage, disposal or use, shall ensure that all required information has been provided in a complete and accurate manner and in compliance with 310 CMR 30.310 before the waste is transported off-site. Failure to complete any applicable portion of the manifest in compliance with 310 CMR 3 0.000 and the directions on the manifest shall be a violation of M.G.L. c. 21 C and of 310 CMR 30.000". ACTIONS)TO BE TAKEN AND THE DEADLINE FOR TAKING SUCH ACTION(S): The following action(s)to be taken have individual deadlines associated with them. Your company shall take the necessary steps to correct the violations within the specified deadlines as noted and shall return to compliance with the requirements described below. The Department's regulations at 310 CMR 5.09 presume receipt of this Notice of Noncompliance,if delivered by regular mail,three business days after its date of issuance. Furthermore,your company shall submit a written response within fifteen (15) days of receipt of this Notice, acknowledging receipt of this Notice, describing the actions already taken, and describing actions intended to be taken in order to achieve and maintain compliance with the Regulations. A. Hazardous Waste 1. Effective immediately, comply with 310 CMR 30.682 with respect to proper labeling of the waste oil containers. 2. Effective immediately,comply with 310 CMR 30.341(5)with respect to designating the waste oil accumulation area. 3. Effective immediately,comply with 310 CMR 30.253(6)(c)with respect to posting the waste oil accumulation area.. 4. Effective immediately, comply with 310 CMR 30.341(4&5)with respect to the hazardous waste accumulation area standards. 5. Effective immediately, comply with 310 CMR 30. 682 with respect to proper labeling of the hazardous waste drum. 6. Within seven days of receipt of this Notice;comply with 310 CMR 30.342(1)(e)with :respect to providing the drum of hazardous waste with an impervious surface and containment. 7. Effective immediately, comply with 310 CMR 30. 341(3)with respect to maintaining a .secure hazardous waste accumulation area. .8. Effective immediately,comply with 310 CMR 30.311(1)with respect to using the company permanent hazardous waste ID#on all hazardous waste manifest shipments. In addition, a company representative indicated that during the fall boat haul out process, Millway Marina washes the bottoms of some boats to remove accumulated marine growth. Removal in the year I have enclosed information regarding tank testing . ** In order to have your tank tested you must first contact an engineering company (see attached) to have a monitoring - -well installed ...Once the monitoring well has been Installed you can then call 362•-2511 , Ext.334 and ask for Charlotte Stiefel or George Heufelder at the Barnstable County Health Department, to have your tank tested via the Soil Vapor Analysis Test. Currently, the test is done free of charge under the auspices of an EPA grant. Due to the unknown age of your tank we must presume it is twenty (20) years of age. You must have it tested every year and remove it by the year 1993 . To have it tested please follow the procedure as indicated above from the ** (asterisk) on.
