I have followed up with the State Dept. of Public Health regarding the bedrooms and lack of windows, and they stated unless there is an exemption you can prove to us, we will not sign off on an occupancy permit, or an inspection that passes saying it meets the criteria of 105 CMR 410.000. The Building Commissioner may make the decision that there are adequate means of egress from the bedrooms without windows, and that would exempt you from 105 CMR 410 450: Means of Egress, as long as he signs off on that. Under 105 CMR 410.250 (A): Habitable Rooms Other than Kitchen-Natural Light and Electrical Outlets: you must have "transparent or translucent glass which admits light from the outdoors and which is equal in area to no less than 8%of the entire floor area of that room.", and 105 CMR 410.251 Kitchen lighting, same light requirements if over 70 square feet. I do not know what regulations you fall under for your licensing, but if it is anything that needs to meet 105 CMR 410.000 we cannot sign off until all of the regulations are met. If you fall under 102 CMR 3.00, Residential Regulations, under 102 CMR 3.08(1)('b) you would need a signature from the local Health Dept. or the State Dept. of Public Health that the facilities meet the criteria of 105 CMR 410.000, which would mean that you would need to provide the adequate amount of light from the outdoors. Hi Dave, it is apparent that 102 CMR 3.08(1)(b) does require enforcement of chapt. II and that an inspection must be done. You stated the bldg insp said the bldg code over ruled the sanitary code. What areas of the code is he concerned with? Any part of chapt. 11 that references the bldg. code cannot be varied by the boh. 105 CMR 410.840 describes variances; however I would be very careful issuing any variances from the requirements you motioned in bedrooms. Once the board has approved a variance, it sets a precedent for any residential unit. I think the fire dept's concerns are valid and would recommend enforcing the code as is. Thanks for all your help, I appreciate it. Like I said, it is not a typical situation. The Fire Dept. is also concerned. Their theory is, is that even if there is Plexiglas, they can break into it pretty easily during a fire. If there is no window, they won't know where to break through, and it will be much tougher, as all the walls are reinforced with wood, instead of drywall. Howard always inspected our Jail, so we never got to involved with this type. Thanks for the quick response. They are now operating as"Beacon Point." The person I met with today was Kevin Nicastro, LICSW, (e-mail knicastro@fcpinc.org or phone (508) 862-0600)who is the network manager for a business named "Family Continuity Programs." I spoke with our Building Commissioner this morning, and he said the building code over ruled the state housing code. The Fire Dept. was also present, with whom I did a walk through of the facility with this morning. The Building Commissioner stated this is considered "R" because the Fire asked if it was going to be considered "I'for institutional and he said no. I believe they are licensed by OCCS, which now has the new name since they merged with DOE. The children live there full time. Our office has stopped doing the inspections for OCCS as we just don't have the staff to keep up with it. However, there is another state code (102 CMR 3.08 (1)(b))that requires we do the inspections or the State, although my boss has said,to stop having us do them as we don't have the staff to keep up on it. Good Afternoon Paul, I have a problem new to us. Are there exemption s\va riance to 105 CMR 410.000, if so, how does someone go about it getting the variance or exemption? This is in regards to a very special needs housing\school for children that need 24 hour surveillance. This is an existing "school" program that is moving into an existing building in our town that was used as an office previously, and is now being retrofitted to meet their needs. Some of the bedrooms have Plexiglas in front of the windows so the kids cannot escape out the windows. Obviously there is some egress concerns here. The next issue is that some of the bedrooms have no windows at all! Is this allowed, if so, does the State need to approve this? Should I be contacting someone else in the state in regards to this?
