Dear Tom,
I would like the enclosed letters to be a part of the record for the above property. As you
can see we have great concern on the location of the driveway and other concerns. We
are making the Board of Health aware of these problems in anticipation of a possible
sign off for a«building permit. As you might remember all the problems we went through
because of Mr. Blakelys protests that our lot was not suitable for a septic system due to
the lack of proper percolation of the soils.
I do not believe that a proper perk test has been done.on his lot. When the bank
foreclosed on the property they did a perk test and the results were very questionable.
I would expect that the same scrutiny would be done on this lot as was done on our lot,
which is the adjacent lot.

Dear Mr. DiMatteo,
My wife and I live at 3528 Main Street Barnstable Village;we have been made aware
recently that on an adjacent lot to ours the owners are planning on building a house. We
have some concerns on the project as the owners, have in the'past voiced opposition to
our building on our lot. At this time we voice our protest to the issuance of a building
permit.
Our concerns are:
1: We understand the owners of Red Wing lane will not let them use Red Wing
lane for access.
2: I believe that they are planning to use a right-of way across our property. This
right-of way is located in an area designated as wetlands. This was a concern when we
built.
3; If they were to use our land as an access, we would want them to install the
driveway in the middle of the right of way. I believe they are planning to install it to the
West at the edge of the 50 foot right of away.
4: They are also required to go through Historical as they are to the North of 6 and
in the district.
There are also other concerns we have such as Title 5 septic system on this lot..

Dear Josh&Fause,
It was good talking to you the other day! You asked how I liked the fence? I am sure we will get used
to it, we were a little surprised when it went up. I don't know if you knew we were against a fence
going up at this time. At the meeting"we had suggested that you wait until your house location and
plans were finalized before the fence went up. It's your land and you should be able to do what you
want with it. Enough about the fence!
I am sure you are excited about building. On two different occasions I have talked to Debbie, and
requested that we get together on the driveway planning.
I mentioned to George,that I had talked to the state about the so-called wet lands. They thought we
could over turn the findings of the local conservation commission. I understand that George went to
the state and verified my findings.
We will be glad to work with you on getting the driveway approved. Our only concern is that it be
placed as far to the east as possible. As you might be aware, when your father built the Clinger's
driveway it was built to the extreme easterly side of the fifty-foot right of way. I would expect the
same for your driveway over our property. This would give both of us the most privacy when you are
using the driveway. If you walk the area to the east you will find it very flat most of the way. Of
course it would be great if you could use Red Wing Lane for access.
The other concern we have is the expense we had to go through to build the over 800 feet of driveway
to the south of the fifty-foot right of way. As you know, we went to a great amount of trouble and
expense in getting approval, and building the driveway. We also had to acquire additional land at 6A
before we could get a curb cut from the state.
We would expect that you would pay your share of the development costs of the driveway from our
property to 6A, and also share in the maintenance of the driveway.
I hope that we can work things out, and you do not have to go through the aggravation and extra
expenses we went through to build our home.
Please;give us a call so we can get together and discuss the plans for the driveway across our property.

Dear Josh&Fause:
In talking with Josh last Sunday I learned that you have some good news! Congratulations on your new
baby and I hope all works out well with the potential sale of your home.
As I mentioned to you I was disappointed that we did not hear from you, after receiving our letter
dated March 20, 2002.
I am still very concerned where your driveway will be placed on our land. As you know there is a
fifty-foot right away across our land. We would expect you to follow the design and placement of the
800 feet of driveway that is across the Jackson property adjacent to ours. This driveway is a
continuation of the fifty-foot right of way on our property.
As mentioned to you Sunday we will support you if you develop the driveway to the far East of the
right of way.
Again I hope that we will hear from you soon! .
