The variances granted are as follows: N Section.360-1: The soil absorption system will be located 89 feet away from a bordering vegetated wetland, in lieu of the one-hundred (100) feet minimum separation distance required. Section. 360-1: The septic tank will be located 81 feet away from a bordering vegetated wetland, in lieu of the one-hundred (100) feet minimum separation distance required. Section. 360-1: The proposed reserve area for the soil absorption system will be located 86 feet away from a bordering vegetated wetland, in lieu of the one-hundred (100) feet minimum separation distance required. These variances are granted with the following conditions: (1) No more than three (3) bedrooms maximum are authorized at this property. Dens, study rooms, offices, finished attics, sleeping lofts, and similar-type rooms are considered "bedrooms" according to the MA Department of Environmental Protection. (2) The applicant shall record a properly worded deed restriction, signed by the owner of the property, at the Barnstable County Registry of Deeds restricting the property to three (3) bedrooms maximum. A copy of the Q:DibbsSaltedrealtyTrust2006Rev2 sic r recorded deed restriction shall be submitted to the Health Agent prior to obtaining a disposal works construction permit. (3) The septic system plan shall be revised to show all septic system components will be-located a minimum of ten feet-away from the center of the stone wall on the westerly property line (using the most restrictive center point on the wall located adjacent to the septic system). The stone wall is not to be undermined or altered in any way during the excavation and completion of this project. (4) The designing engineer shall supervise the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system was installed in substantial compliance with the revised plans. These variances are granted because the physical constraints at the site severely restrict the location of the soil absorption system due to the close proximity of wetlands adjoining the property. We are direct abutters and join the other abutters in objecting to compromising the subsurface disposal of sewage regulations to allow for new construction. The owners/developers have their home next to this lot for sale, while we are all entitled to develop our properties to maximize profit and sell,variances from health regulations are not appropriate means to that end. We respect the quality of life this town affords and respect its regulations, set forth to ensure the quality of life is not compromised. The variances seek to,set aside the protection of health regulations, not for an existing dwelling that is enduring a hardship but for new construction; the development of a piece of land that is not by the towns regulations, legally suited for such development. My reasons area falleEvs; 1. The soil conditions in this area are very poor, and I would be concerned regarding any variance to a system in an area that seems marginal for a septic system. 2. As drawn, I think some of the septic system for this plan is inside the 100' buffer for the wetlands, and that concerns me. 3. The ocation of the septic system is extremely close to our property line, and I'm concerned that ishould the septic system fail that we would experience pollution on our property. 4. The Conservation Commission has expressed concerns about the project. In summary, I'm hopeful that the Board of Health will look at this proposed system very carefully and if the system is ultimately approved, I would hope that the location of the system would be reevaluated so that it is less close to our property line. We are the direct northerly abutters to 71 Tonela Lane. On February 281h' we were in attendance at the Conservation Commission's meeting at which the Notice of Intent for new construction for 71 Tonela Lane was considered by the Commission. We were happy to hear that the Commission was requesting additional information and more time for consideration regarding the project and that you are asking for.the project to be downsized due to the potential impact on the wetlands and the impact on the 50' buffer zone. As was discussed, the project takes up almost the entire 50' buffer zone. At the meeting, I expressed my concern regarding the septic system, given the clay-like soils in the area, since nothing drains particularly well in our neighborhood. Further, I would like to express my concern of the location of septic system as it is so close to our property line. I hope that the commission will undertake every possible consideration before approving a building on this site, given how little space there is to work with and given the possibility of the impact on the wetlands and within the 50' buffer. There has already been a fair amount of damage to the wetland area, in my opinion, due to the testing of the soil. It also concerns me that the project can be completed, in such tight confines, without further interruption. Finally, I have received notification that the engineers for this project, BSC Group, Inc., are requesting a variance from the Barnstable Board of Health regarding the septic system they've designed for the project. While I have no knowledge of septic systems, it concerns me, as a neighbor, that variances would be given to a septic system where the soil conditions are poor and given the proximity to wetlands. Our serve, indicates '` the stone wall is the western boundary. The deed indicates a length of appro ,. 120' not 150' as the scale on the plan indicates. 2. Barnstable has 1 acre zoning. This lot is .76 acre, including a considerate amount of wet areas. 3. This property is visibly wet after even a moderate rainfall. Previous"perc"tests have failed. Although a pocket of high/dry land was found at the very edge of the property, it still does not meet setback requirements. 4. This piece, in a desirable "north of 6a"location, at a time of rapidly rising property values and a dwindling supply of building lots,was unable to find a buyer or builder willing to overlook it's shortcomings. The ultimate.se_lling price of$10.00 suggests an understanding of this property's limitations 5. The fact that this parcel may have risen to the top of the list of properties worth pursuing simply because most conforming parcels are gone shouldn't weaken applicable regulations. 6. Allowing this inexpensive,undersized,marginal property to be developed so as not to interfere with the owner's ability to realize full capital appreciation, compromises the abutters' ability to do the same—all of whom paid far more than$10.00 for their properties, and all of whom were under the impression this lot was not buildable. These, and perhaps other yet to be discovered, facts make it difficult to call this a hardship case. Zoning and septic regulations have been in place long enough to be known at the time of purchase. There is no financial hardship. Granting variances for existing dwellings seems appropriate. Variances for marginal vacant lots does not. _ We would hope the regulations governing residential septic systems were created after much deliberation and reflect a valid concern based on scientific fact,not just random musings that can be easily challenged. t. r Disrespect for existing rules and the liberal use of variances makes a mockery of the town and of all those that abide by established regulations.
