Executive Summary
On behalf of the Applicant, Housing Assistance Corporation of Cape Cod., DiPrete Engineering is
submitting a Notice of Intent (NOI) Application for proposed stormwater management features
associated with a proposed 50-unit apartment building. Parking and stormwater management features
are located within the 200’ Riverfront area of an unnamed inland stream protected under the
Massachusetts Wetlands Protection Act (WPA, M.G.L, c. 131, s. 40) and its implementing Regulations
(310 CMR 10.00). All remaining site development is located outside of the 200’ Riverfront area. The
project is concurrently being filed with the towns Site Plan review committee and Project details are
depicted on the site plans entitled Site Plan Review – Stevens Street Multi-Family, prepared by DiPrete
Engineering, last revised June 4, 2024 (Sheets 1-17).
Introduction
On behalf of the Applicant, Housing Assistance Corporation of Cape Cod., DiPrete Engineering is
submitting a Notice of Intent (NOI) Application for proposed stormwater management features
associated with a proposed 50-unit apartment building. Parking and stormwater management features
are located within the 200’ Riverfront area of an unnamed inland stream protected under the
Massachusetts Wetlands Protection Act (WPA, M.G.L, c. 131, s. 40) and its implementing Regulations
(310 CMR 10.00).
Stormwater management has been designed in accordance with the Massachusetts Stormwater
Handbook, Stormwater Management Standards, and the WPA Regulations, as depicted on the site plans
entitled Site Plan Review – Stevens Street Multi-Family, prepared by DiPrete Engineering, last revised
June 4, 2024, and detailed within the Stormwater Management Report, prepared by DiPrete
Engineering, revised March 15, 2024. A Stormwater System Operation and Maintenance Plan and
Stormwater Pollution Prevention Plan both prepared by DiPrete Engineering, dated November 29, 2023
also accompany this NOI.
The following NOI Application provides a description of the existing site conditions, Wetland Resource
Areas, and proposed project designed to protect the interests and values of the Wetland Resource Areas.
All remaining site development is located outside of the 200’ Riverfront area.
Project description
The site is located at the intersection of Stevens Street and North Street. Access to the site comes from
Stevens Street that borders the East side of the site, and Mitchell’s Way that borders the Southwest side
of the site. Neighboring the site is a residential and commercial development to the North and a Church
and residential development to the West. A 200’ Riverfront area of an unnamed inland stream, is
located along the western property line.
The site totals 1.49 acres and is located in the Stewarts Creek (MA96-94) watershed. The site’s
stormwater trajectory flows from the site to the town’s drainage network, then discharging to Aunt
Betty’s Pond prior to ultimately reaching Stewarts Creek.
Currently the site exists today as fully disturbed and vacant lot with sections of pavement and dirt piles
from a previously demolished Collision Center or vehicle maintenance building. Based on aerial imaging,
it is presumed that the development was demolished sometime between 2016 and 2017. The entire
riverfront area located within the property has been previously disturbed as part of the demolition of
the existing development between 2016 and 2017. The subject development proposes to restore 5,538
SF, about 37% of the riverfront area within the site, with pervious cover. Reducing the existing
disturbance and increasing the pervious cover along the riverfront area provides an improvement of the
riverfront and the streams watershed from pre to post condition.
For the purpose of our stormwater analysis, the demolished development of the collision center and
vehicle maintenance, has been considered as the pre-development condition. Based on the oldest
available aerial imaging from 1990, the development has existed for over 25 years with its stormwater
practices ultimately discharging stormwater runoff to the town’s drainage network. The intent behind
this is to provide accurate pre-existing conditions of the site with its stormwater systems as it provided
some stormwater treatment practices prior to discharging into the town’s drainage network. The current
vacant condition would represent silted and failed systems which provide no peak attenuation in the
town’s drainage system. Making these assumptions ultimately results in a conservative approach as the
pre-development peak flows and volumes to the existing drainage network are reduced and establishes
the maximum peak and volumes that need to be met in post-development.
The proposed development will include one 3-story multi-family building with associated access drives,
parking, drainage, and utilities. Parking and stormwater management features are located within the
200’ Riverfront area of an unnamed inland stream protected under the Massachusetts Wetlands
Protection Act (WPA, M.G.L, c. 131, s. 40) and its implementing Regulations (310 CMR 10.00). The site
will be serviced by public water and sewer.
Stormwater treatment and mitigation will be provided by utilizing Best Management Practices (BMPs) as
established by the Massachusetts Stormwater Handbook. BMPs will consist of one Underground
Infiltration System for roof runoff, 5 runoff collection and infiltration systems (Stormcrete), an
aboveground infiltration pond with a sediment forebay, and 5 leaching catch basins for site stormwater
treatment.
The system has been designed to meet the MADEP Stormwater Handbook, otherwise known as the
Massachusetts Stormwater Management Standards (MASWMS), and the Town of Barnstable Code
Regulations.
Floodplain Designation
The site is located in the FEMA Flood Zones X with minimal flooding per FEMA flood Insurance rate map
25001C0568J, revised July 16,2014.
Massachusetts Natural Heritage & Endangered Species program Designation
The site is not located within a Priority or Estimated Habitat of Rare Species or Rare Wildlife.
Inland Wetland Resource Area
Inland Wetland Resource Areas on-site protected under the WPA include Riverfront as described in 310
CMR 10.58.(2)(a) – “A Riverfront Area is the area of land between a river's mean annual high-water line
and a parallel line measured horizontally. The riverfront area may include or overlap with other resource
areas or their buffer zones. The riverfront area does not have a buffer zone.”
General Performance Standards
As described in 310 CMR 10.58.(4), the performance standards have been reviewed as noted below:
a. Protection of Other resource areas – The work shall meet the performance standards for all other
resource areas within the riverfront area, as identified in 310 CMR 10.30 (Coastal Bank), 10.32
(Salt Marsh), 10.55 (Bordering Vegetated Wetland), and 10.57 (Land Subject to Flooding).
The site and its disturbance are located within the 200’ riverfront area only. The unnamed
stream is located about 150’ off the property.
There is 13,240 SF of Riverfront area that enters the site. The entire riverfront area located
within the property has been previously disturbed as part of the demolition of the existing
development between 2016 and 2017. The subject development proposes to restore 5,538 SF,
about 37% of the riverfront area within the site, with pervious cover. Reducing the existing
disturbance and increasing the pervious cover along the riverfront area provides an
improvement of the riverfront and the streams watershed from pre to post condition.
b. Protection of Rare Species. No project may be permitted within the riverfront area which will
have any adverse effect on specified habitat sites of rare wetland or upland, vertebrate or
invertebrate species, as identified by the procedures established under 310 CMR 10.59 or 10.37,
or which will have any adverse effect on vernal pool habitat certified prior to the filing of the
Notice of Intent.
The site is not located within the Natural Heritage Estimated Habitats of Rare Wildlife or Priority
Habitats of Rare Species. The riverfront area is presently disturbed with houses, driveways and
roadways. The site will not cause further impacts to the riverfront area and will restore 37% of
the sites Riverfront area with pervious area and plantings thus improving wildlife and species
than what presently exist today. There are no vernal pools within or immediately abutting the
property.
c. Practicable and Substantially Equivalent Economic Alternatives. There must be no practicable
and substantially equivalent economic alternative to the proposed project with less adverse
effects on the interests identified in M.G.L. c. 131 § 40.
The is no practicable and substitutionally equivalent economic alternative for the proposed
project with less adverse effects. Due to the site size, location, topography, town code and
ordinance, the site has been designed to reduce all environmental impacts to the maximum
extent practicable by limiting the disturbance, providing a reduced number of parking spaces.
The site will not cause further impacts to the riverfront area and will restore 37% of the sites
Riverfront area with pervious area and plantings thus improving the riverfront than what
presently exist today.

Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
