It has come to their attention that,on the basis of information provided to you by attorney Thomas N.George,you have issued an opinion that the lot referred to above would be "grandfathered"from present dimensional zoning requirements by virtue of its status as a nonconforming lot since 1941. The provisions of MGL Ch.40A §6 provide,in part,the following: "Any increase in area,frontage,width,yard,or depth requirement of a zoning ...bylaw shall not apply to a lot ...which at the time of recording or endorsement,... was not held in common ownership,with any adjoining land, conformed to the existing requirements and had less than the proposed requirement but at least 5,000 square feet of area and 50 feet of frontage." It is the opinion of this office that the "grandfather clause"of the above provision clearly does not apply to Mr. Perry's land,since said lot contains only 13.75 feet of frontage on Pine Street. Please be advised that the clients of this office are alarmed by the intended construction of any structure on said lot,and will resort to any and all means legally permissable to enforce the provision of MGL Ch.40A and their rights. This is a situation where Horatio:Nelson Perry, II acquired title by deed of Raymond C.Batting,which is recorded in Book 339,Page 100.That deed is dated and recorded at the Registry in 1914,a copy of that deed is enclosed and marked "A".The entire parcel is shown on the enclosed blow-up as sketched out in yellow. Later,the front parcel,which-is shown in red,was con veyed out by deed in 1941 and it has been in that owner ship since that date.The configuration of the two prop erties have existed as they are shown in red and blue since the deed out in 1941.As a result of the deed out, the frontage to the blue property is 13.75 feet,more or less.There has never been any further subdivision of the parcel outlined in blue or red. My clients,the heirs of H.Nelson Perry,would like to draw a building permit on their property and I would appreciate your reviewing this situation and notifying us in writing whether or not under the current circumstances,with the width of their access onto Pine Street,and under the current building codes and zoning regulations they can now proceed to draw that building permit. It is my interpretation that the H.Nelson Perry lot as shown on this plan is a non-conforming lot and Mr.Joseph Daluz,Building Inspector JDctober 3,1983 Page'2 though it does not have the requisite frontage as estab lished by the present code,it is "grandfathered"and the 13.75 foot access is adequate and the lot is buildable. There appears to be a problem on the right side of the entrance to the property in that there is a tool shed either on the entrance or too close to it.The property is in the process of being sold so this has to be cleared up. I would appreciate your assistance in this matter. |ncerely, aldine^Jerry"Bennett 'Agent for H.Angus Perry,Trustee 'I PROPOSAL:Angus Perry,administrator of the estate of H.Nelson Perry II,has offered to the Town Parcel 52,Assessor's Map 229 (listed as 3.03 acres),on Long Pond off of Pine Street,Centerville,for $33,000 to be paid over a three year period in equal amounts of $11,000 per year without interest. The Conservation Commission has offered $30,000 for the parcel,also to be paid over a three year period,contingent upon the approval of the Finance Committee.The initial $10,000 payment would be paid out of the Conservation Acquisition Fund.However, Town Counsel has ruled that the Town cannot enter into a legally binding contract based upon the payment of money that has not yet been appropriated (i.e.the remaining $20,000). Vfhen notified of this problem,Mr.Perry agreed to give the Town an additional 48 hours (until Friday,July 27)to make a final offer.He has verbally agreed to the $30,000 offer,payment to be arranged in whatever manner is most convenient for the Town (lump sum,or over a period of two or three years). WHY THIS LAND SHOULD BE ACQUIRED BY THE TOWN: A.The parcel is consistent with the two primary criteria proposed by the Open Space Plan to evaluate potential conservation acquisitions (p.85): 1."Land within the zones of contribution of public supply wells." Although the parcel falls just outside of a zone of contribution,it is directly upgradient of three public supply wells belonging to the Centerville/Osterville Water District. 2."Waterfront land....that provides enhanced recreational opportunities...." The property directly abuts the existing Town beach on Long Pond,and would add 30 feet to that beach.In addition,it could be used for the future development of that beach into a small neighborhood park (e.g.picnic area, nature trail).It also serves as a natural buffer between the Town beach and residential development which is occurring on property to the east of of the beach. B.The parcel would provide some badly needed public open space for the village of Centerville.
