Request & Background:
The owner and applicant, Peter and Patti Ann Farrar of 134 Strawberry Hill Road, Centerville have
requested a release of covenant for a lot within subdivision number 333. The specific request is to release
the covenant of a lot from a subdivision that was approved in 1973 and has since been fully occupied. The
lot in question is improved with a single family home and served by both the subdivision road Putter Lane
and Strawberry Hill Road.
The applicant, in conducting a title search, was unable to uncover a recorded release of covenant at the
Barnstable County Registry of Deeds and is requesting a new release of lot be granted.
Procedure:
The request was filed with the Planning Board’s Office on August 23, 2024. In order to release a lot from
covenant, the applicant shall file with the Planning Board for review at a regularly scheduled public
meeting.
The release of covenant shall be by majority vote of the Planning Board.
The request was reviewed by the Town of Barnstable’s Engineering Division and was determined to have
no known outstanding subdivision issues that would result in the denial of a release of covenant.
Correspondence:
A request for comments has been sent to the Town Engineer. The Town Engineer forwarded the request
to the Planning Board and has no concerns.
Draft Motion:
If the Board agrees to the requested change, a motion should be formulated to Release the Covenant for
134 Strawberry Hill Road, Centerville, Subdivision 333 as identified in the submission to the Planning
Board.
