East Wareham, Massachusetts 02538 Ph. 508-273-0377    September 19, 2024 Town of Barnstable Conservation Commission 367 Main Street Hyannis, MA 02601 RE: Amended Order of Conditions Request 289 East Bay Road, Osterville, Massachusetts MassDEP File#: SE3-6008 Dear Sirs and Madams: On behalf of the owner of 289 East Bay Road (289 East Bay Road, LLC), we’re requesting an Amended Order of Conditions (AOOC) under DEP File No. SE3-6008 for the project located at 289 East Bay Road, Osterville, Massachusetts. Please find enclosed a plan entitled “Proposed Site Plan” located at 289 East Bay Road, Osterville, Massachusetts, dated March 17, 2022 (REV.2: 9-19-24), for your review and approval. The subject lot at 289 East Bay Road is 57,236+/- square feet (1.31+/- acres) in size and has an existing single-family home, paved driveway, walkways, landscaping, utilities, septic system, etc. There is an onsite wetland on the west side and south side of the existing home. Across the road from the property, there are two separate Coastal Banks (depicted on the attached site plan as Coastal Bank #1 and Coastal Bank #2), and a Salt Marsh behind the banks along East Bay. Also, the property falls within Land Subject to Coastal Storm Flowage Zones AE (EL.12) and AE (EL.13) as shown on the attached plan. In 2022, the Conservation Commission approved a Notice of Intent for the original project at 289 East Bay Road (DEP File No. SE3-6008). The approved work primarily consisted of additions (vertical and horizontal) to the existing single-family home, construction of a pool & hot tub, and the upgrade of an existing septic system with a new I/A system. The work has already started, but now the owners would like to make some changes to the scope of work. The changes proposed under this AOOC are as follows: 1.) Replace existing paved driveway in the front yard with a crushed stone driveway within same footprint (shown in hatch on site plan). 2.) Remove a concrete pad at the end of the driveway near the existing garage. This area will be replaced with loam and seed. 3.) Rotate proposed pool 90 degrees and add a concrete apron around it. 4.) Rebuild a portion of the existing deck next to the proposed pool. 289 East Bay Road September 19, 2024 Page 2   5.) Rebuild an existing 1.5-ft± high stone wall along the driveway (west side of house) and extend the wall to the front of the house. 6.) Add 2 cobblestone aprons at both driveway entrances from East Bay Road to the property. 7.) Add 1 cobblestone apron between the existing paved driveway and proposed crushed stone driveway. All other work approved under DEP File No. SE3-6008 will remain unchanged. The approved work did not require any planting mitigation whereas we had proposed essentially a net 0 of additional hardscape. Planting mitigation will not be required for the new scope of work as well. As a matter of fact, we are proposing to reduce the overall hardscape for the property by 729 s.f. and this does not include the replacement area of the paved driveway with crushed stone as proposed. No credit was taken for this surface material change. We feel that the new work will create no alteration to the resource areas. To ensure protection of the resource areas, haybale barriers are proposed to be located between the limit of the proposed work and the edge of the resource areas as shown on attached plan.
